AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON CERTAIN PORTIONS OF U. S. 82, AS HEREINAFTER MORE PARTICULAR- LY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING PLACE- MENT OF SIGNS WITH RESPECT THERETO; REPEALING CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS ORDINANCE ONLY TO STREETS OR HIGHWAYS NAMED HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SAVINGS CLAUSE AND FOR PUBLICATION HEREOF, AND A PENALTY CLAUSE. WHEREAS, the governing body of the City of Lubbock, upon the basis of an engineering and traffic investigation finds it necessary to alter prima facie speed limits established by Article 6701d, Section 166(a)l, Vernonts Texas Civil Statutes as amended Acts 1971, 62nd Legislature, page 708, Chapter 73, within the area and at the location named and designated in the body of this Ordinance, all within the corporate limits of the City of Lubbock: NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT prima facie speed limits on the following streets and highways in the urban district set forth below is hereby altered and changed as hereinafter set forth upon the following described portions of streets and/or highways located within the City of Lubbock# Lubbock County, Texas, to-wit: U. S. 82 (Brownfield Highway, Tech Freeway) From University Avenue to 19th Street (S. H. 116) Northeasterly Bound A 40 MPH speed zone beginning at the intersection of 19th Street (S. H. 116) and extending northeasterly a distance of 0. 204 mile. A 55 MPH sp~ed zone beginning at a point 0. 204 mile northeast of 19th Street (S. H. 116) and extending northeast a distance of O. 356 mile. A 50 MPH speed zone beginning at a point 0. 560 mile northeast of 19th Street (S. H. 116) and extending northeast a distance of O. 200 mile. A 55 MPH speed zone beginning at a point o. 760 mile northeast of 19th Street (S. H. 116) and extending northeast a distance of O. 738 mile. LGB:hw A 50 MPH speed zone beginning at a point 1. 498 mile northeast of 19th Street (S. H. 116) and extending northeast a distance of O. 200 mile. A 40 MPH speed zone beginning at a point 1. 698 mile northeast of 19th Street (S. H. 116) and extending to University Avenue a distance of O. 2 80 mile. Southwesterly Bound A 35 MPH speed zone beginning at University Avenue and extending to Boston Avenue a distance of 0. 200 mile, A 40 MPH speed zone beginning at Boston Avenue and extending a distance of O. 250 mile. A 50 MPH speed zone beginning at a point O. 250 mile west and southwest of Boston Avenue and extending southwesterly a distance of O. 250 mile. A 55 MPH speed zone beginning at a point O. 500 mile from Boston Avenue and extending southwesterly a distance of O. 318 mile. A 50 MPH speed zone beginning at a point 0. 818 mile from Boston Avenue and extending southwesterly a distance of 0. 20 0 mile to Indiana Avenue•- A 55 MPH speed zone beginning at Indiana:·Avenue and extending southwesterly a distance of 0. 556 mile. A 40 MPH speed zone beginning at a point O. 556 mile south- west of Indiana Avenue and extending to 19th Street (S. H. 116) a distance of 0. 223 mile. SECTION 2. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 3. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically connicts. THE City Manager is hereby authorized and directed to cause the placing and maintenance of such traffic control signals and/ or devices and/or signs as shall be necessary to appr~e the public of the M. P.H. zones as hereinabove set forth. SECTION 5. THAT should any Section, paragraph, sentence. clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction befined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS. SECTION 7. THAT the City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. AND IT IS SO ORDERED.
