AN ORDINANCE AMENDING SECTION 2-36 OF THE CODE OF
ORDINANCES, CITY OF LUBBOCK., TEXAS, BY PROVIDING FOR THE
TERMS OF OFFICE OF THE ELECTRIC UTILITY BOARD; PROVIDING
FOR QUA LI FICA TIO NS OF BOARD MEMBERS; PROVIDING A SA VIN GS
CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that the changes
indicated below, would be in the best interest of the citizens of the City
of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION I. THAT Section 2-36 of the Code of Ordinances., City of
Lubbock., BE and is hereby amended by amending sub-sections (c) and
{e) thereof to read as follows:
"(c) TENURE: The present members of the Electric
Utility Board shall continue to serve as members of
such Board with the expiration date of their terms to
be set by the C ity Council. All successive appointments
shall be for terms of four (4) years. 11
11 (e) QUALIFICATIONS: No person, shall be a member
of the board unless he shall have been for at least two
(2) years next preceeding his appointment a resident
elector of the city., and unless he shall believe in the
desirability of a competitive operation of electric
production and distribution and shall have no sub-
stantial ownership, interest in or income derived from
any electrical contractor or supply or electrical
utility business located or doing business in Lubbock
County. Any member who fails to attend three (3)
consecutive regular board meetings for any reason
other than sickness or absence from the city or who
shall fail to attend at least fifty per cent (50%) of
the regular meetings in any one year shall become dis -
qualified to serve on the board, and upon certification
of such absence from the secretary to the board, the city
council shall thereupon appoint a successor to complete
the unexpired term.
SECTION 2. THAT should any section, paragraph, sentence,
clause, phrase or word of this Ordinance be declared unconstitutional or
invalid for any reason, the remainder of this Ordinance shall not be
affected thereby.

SECTION 3. TH.AT the City Secretary is hereby authorized to
cause pub! ication of the descriptive caption of this Ordinance as an
alternative method provided by .law.
AND IT IS SO ORDERED.
