Code By Amending Sec. 5-2 - 01/23/1972I{ /} , rY,s J:sw ORDINANCE NO. 028 _ ....... :..:...-----1 AN ORDINANCE AMENDING CHAPTER 5 OF THE CODE OF ORDI- ANCES, CITY OF LUBBOCK, TEXAS. (BEING THE BUILDING CODE) BY MENDING SECTION 5-2 THEREOF BY PROVIDING FOR AN AMENDMENT 0 SECTION 204 THEREOF WHICH PROVIDES FOR A BOARD OF APPEALS; ROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has found that the changes indicated below ould be in the best interest of the citizens of the City of Lubbock; NOW HERE FORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CIT¥ OF LUBBOCK: SECTION 1. THAT Section 5-2 of Chapter 5 of the Code of Ordinances ity of Lubbock, (being the Building Code), B~ and ~ hereby amended by ending Section 204 of Chapter 2, of the Uniform Building Code, 1973 Edi- ion, to read as follows: "Sec. 204. Board of Appeals. In order to determine the suitability of alternate materials and methods of construction and to provide for reasonable interpretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals., consisting of seven (7) members who are qualified by experience and training to pass upon matters pertaining to building con- struction with at least one member being from the home building industry. The Building Official shall be an ex- officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the Mayor and shall hold office for a term of four (4) years. except that two (2) of the members first appointed shall hold office for terms of one (1) year, ending June 1, 1976, two (2) members shall hold terms of office of two (2) years, ending June 1,. 1977, two (2) members shall hold terms of office for three (3) years, ending June 1., 1978., and one (1) member shall hold office for a term of four (4) years. ending June 1, 1979, the respectiv e terms of the firstm'embers appointed shall be as determined by the City Council~ ... and thereafter their successors shall hold office for four (4) years and until their successors are appointed. '' "The Board shall adopt,reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Building Inspector with a dup- licate copy to the Appellant and may recommend to the City Council such new legislation as is consistent therewith. " SECTION 2. THAT should any Section, paragraph, sentence., clause, hrase or word of this Ordinance be declared unconstitutional or invalid for ny reason, the remainder of, this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause ublication of the descriptive caption of this Ordinance as an alternative meth rovided by law.
