IONS; PROVIDTh"'G A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has een duly pres~nted to the Zoning and Planning Commission for its recommendatio hich was received by the City Council and, after due consideration, the City ouncil finds !hat making the proposed change as hereinafter set out will be in the ublic interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to he Zoning O:dinance and Map have been fully complied with, as well as giving otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro- ided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and otice was duly published in the Lubbock Morning Avalanche Journal more than fif .. een (15) days prior to the date of the public hearing before the City Council on sue roposed amendment, and the public hearing according to said notice was duly held the City Council Room on the second floor of the City Hall, Lubbock, Texas, at hich time persons appeared in support of the proposal; and, after said hearing, it as by the City Council determined that it would be in the public interest~ due to hanged conditions, that the Zoning Ordinance and the Zoning Map be amended in he manner hereinafter set forth ill the body of this Ordinance and this Ordinance aving been introduced prior to first reading hereof; NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and t arne are hereby amended as follows, to-wit: ZONE CASE NO. 1008B Change Lot 53 7 and 5 34, Kuykendall Heights Addition, City of Lubbock, Lubbock CountyJ Texas, from an 11R-1 11 Specific Use to a "C-3" Zoning District. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Development of property shall be in accordance with the site plan presented and approved herewith. 2. "C-2" sign regulations shall apply. = 3~ A 130 foot building setback from 50th Street shall be observed. 4. Three square feet (3 sq. ft.) of paved off ... street parking space shall be provided on the property for each square foot of total building space. SECTION 2. THAT from and after passage and effective date of this Ordin ... ance. said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accord ance herewith. SECTION 3. Should any paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remaind of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
