ORDINANCE NO. 5790
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI-
IAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1637: CHANGE A TRACT OF LAND OUT OF SECTIO
9, BLOCK E-2, LUBBOCK COUNTY, TEXAS, FROM AN "R-111 TO AN "A-111
ONING DISTRICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
UBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made has
een duly presented to the Zoning and Planning Commission for its recommendatio
hich was received by the City Council and, after due consideration, the City
Council finds that making the proposed change as hereinafter set out will be in the
ublic interest; and,
WHEREAS, all conditions precedent required by law for a valid amendme
o the Zoning Ordinance and Map have been fully complied with, as well as giving
otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro
ided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and
otice was duly published in the Lubbock Morning Avalanche Journal more than fif-
een (15) days prior to the date of the public hearing before the City Council on sue
roposed amendment, and the public hearing according to said notice was duly held
· the City Council Room on the second floor of the City Hall, Lubbock, Texas, at
hich time persons appeared in support of the proposal; and, after said hearing,
't was by the City Council determined that it would be in the public interest, due to
hanged conditions, that the Zoning Ordinance and the Zoning Map be amended in
t he manner hereinafter set forth in the body of this Ordinance and this Ordinance
aving been introduced prior to first reading hereof; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
he same are hereby amended as follows, to-wit:
ZONE CASE NO. 1637
Change a tract of land out of Section 9. Block E-2, Lubbock County,
Texas, from an 11R-111 to an "A-111 Zoning District. Property is further
described by metes and bounds to-wit:
A 6001 X 6351 tract of land out of the North 1/2 of the Northeast 1/4
of Section 9, Block E-2, Lubbock County, Texas and more particular
described by metes and bounds as follows: ,-··'
BEGINNING at a point which is 2640 feet West and 1320 feet South
of the Northeast Corner of Section 9, Block E-2, Lubbock County,
Texas for the beginning corner of this tract;
THENCE North a distance of 600 feet to a point for the Northwest
corner of this tract;
THENCE East a distance of 635 feet to a point for the Northeast
corner of this tract;
THENCE South a distance of 600 feet to a point for the Southeast
corner of this tract;
THENCE West a distance of 635 feet to the PLACE OF BEGINNING.
SECTION 2. THAT from and after passage and effective date of this Ordinan
said lots, tracts and parcels of land described in Section 1 hereof shall be changed
to the zoning district indicated and the Official Map is amended in accordance
herewith.
SECTION 3. Should any sect ion, paragraph, sentence, clause .. phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized. to cause publica-
tion of the descriptive caption of this Ordinance as an alternative method provided
by law.
AND IT IS SO ORDERED.
