TION 6, BLOCK E-2, LUBBOCK COUNTY, TEXAS FROM "R-3 11 TO "A ... 111 ZON ... ING DISTRICT; PROVIDING A SAVINGS CLAOSE AND PROVIDING FOR PUBLICA TION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion, which was received by the City Council and, after due consideration, the Ci~ Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required b7law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro vided by Article 1011f, Vernon1s Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fif ... teen (15) days prior to the date of the public hearing before the City Council on sue proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock. Texas. at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1, THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to .... wit: ZONE CASE NO. 1585B Change a tract of land out of Section 6, Block E-2, Lubbock County, Texas, further described as follows, from "R-3" to 11A-l"l2:oning district: STARTING at a point 1320 feet South and 70 feet West of the Northeast Corner of said Section 6; THENCE West 479.30 feet to a point; THENCE North 150 feet; THENCE North 65°04' East 391.86 feet to a point; THENCE South 185. 19 feet; THENCE East 220 feet; THENCE South 130 feet to the PLACE OF BEGINNING. SECTION 2. THAT from and after passage and effective date of this Ordin ... ance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accord- ance herewith. SECTION 3. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. Senter, l':; CitYAttorn~ Ulflll Apprqyjjt 2 1 Hold Zoning Hearing on Zone Case No . 1585B - Request of the Planning and Zo~in g Commission to change property located north of 38th Street and west of Slide Road from ''R-3" to "A-1" zoning district. The Planning and Zoning Commission recommended that this zone change request be granted. If zone change is approved, pass ordinance on first reading. ZONE CASE #1585B This application was one initiated by the Planning and Zoning Commission cov~ring a han~ful of "R-311 pro- perties being considered for a change to the new 11A -1 11 or 11A -211 classifications. The single piece of property covered by the current case on the Council's agenda is one that was initially tabled by the ·Planning and Zoning Comm~ssion for for further consideration and a rehearing on the basis of possible "R-2" classification. Final action of the Commission is a recommendation that the property be changed from "R -3" (with conditions limiting the development to a specific number of four-plexes) to "A-1". As indicated above the property was limited in its development af the point of the initial application by the property owner, which application included commercial frontage along Slide Road. On the basis of the hearing and neighborhood expressions the develop- ment was limited to the applicant's proposal to build a certain number of four-plex units. On the basis of those units the density permitted was very close to one unit for each 3, 000 square feet of lot area, in other words similiar to what would be accommodated under an "R-2" or duplex classificc..tion. This same question of density was raised during the current hearing and led the Planning Commission to initiate the subsequent case to consider a change to "R-211 • However, on final consideration the Planning Commission determined that the 11 A -1" classification was appropriate. From the standpoint of development, and location, and shape of the property it would lend itself to residential developmen t f01· single-family homes, duplexes, or apartments. Under the original "R -311 zoning 44 units were perxnitted on the property; with the rezoning to "A-1 11 69 units are permitted. This increased density is the only problem associated with the proposal. It may be anticipated that a substantial' part of the traffic to and from the apartments which may be built at this location will use 38th Street; with the cul-de-sac at the east end having been designed for single-family residentional purposes this increased traffic will be partially deployed on 38th Street, the south side of which is solidly occupied by existing single-family dwellings.
