ORDlliANCE NO. 5786
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI-
CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1632: CHANGE A TRACT OF LAND OUT OF SECTIO
6, BLOCK E-2, LUBBOCK COUNTY, TEXAS FROM A "C-2 11 TO "C-311 ZONING
DISTRICT; SUBJECT TO CONDITIONS; PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made has
een duly presented to the Zoning and Planning Commission for its recommendatio
which was received by the City Council and, after due consideration, the City
Conncil finds that making the proposed change as hereinafter set out will be in the
ublic interest; and,
WHEREAS, all ~onditions precedent required by law for a valid amendment to
he Zoning Ordinance and Map have been fully complied with, as well as giving
otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro
ided by Article 101lf, Vernon1s Annotated Civil Statutes, amended in 1961, and

een (15) days prior to the date of the public hearing before the City Council on sue
roposed amendment, and the public hearing according to said notice was duly held
· the City Council Room on the second floor of the City Hall, Lubbock, Texas, at
hich time persons appeared in support of the proposal; and, after said hearing,
as by the City Council determined that it would be in the public interest, due to
hanged conditions, that the Zoning Ordinance and the Zoning Map be amended in
he manner hereinafter set forth in the body of this Ordinance and this Ordinance
aving been introduced prior to first reading hereof; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
he same are hereby amended as follows, to .. wit:
ZONE CASE NO. 1632
Change a tract of land out of Section 6, Block E-2~ Lubbock County~
Texas from a 11C-2 11 to "c ... 3'1 Zoning District.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. All building heights shall not exceed one (1) story.
2. A six (6) foot high permanent type solid sc;reening fence of wood or
masonry construction shall be erected arl permanently maintained
along the West and North property lines. No vehicular type openings

shall be permitted in the fence. The fence shall be constructed
prior to or concurrently with the first unit of any building construct-
ion on the property. Said fence shall be slanted or stepped down
from a point 25 feet from both street property lines to a height of
2! feet at the street property lines,
3. "C-2" sign regulations shall apply,
4. Lighting of the property shall be shielded or directed to prevent
glare on adjacent residentially zoned areas.
5. The maximum building area shall be such as will maintain a 3:1
parking area to building area ratio.
6. Minimum building setbacks shall be as follows:
130 feet from 50th Street,
70 feet from Slide Road,
38 feet from West and North property lines.
Except, however. a service station may be constructed to within
43 feet of a street property line, Such setback shall include the
pumps and canopies in addition to the main building,
SECTION 2. THAT from and after passage and effective date of this Ordin-
ance said lots, tracts and parcels of land described in Section 1 hereof shall be
changed to the Zoning District indicated and the Official Map is amended in accord-
ance herewith.
SECTION 3, Should any paragraph, sentence, clause, phrase. or word of thi
Ordinance be declared unconstitutional or invalid for any reason, the remainder of
his Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publica-
ion of the descriptive caption of this Ordinance as an alternative method provided
y law.
