IZE THE ISSUANCE OF A SPECIFIC USE PERlVilT, to ... wit: PROFESSIONAL TYP OFFICES ON THE PROPERTY DESCRIBED IN ZONE CASE NO. 1634 ABOVE: PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendatio which was received by the City Council and, after due consideration, the City Council finds that making the proposed chan~ as here:inafter set out will be in the public interest; and WHEREAS, all conditions precedent required by law for a valid amendment to he Zoning Ordinance and Map have been fully complied with, as well as giving otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro ided in Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and otice was duly published in the Lubbock Morning Avalanche Journal more than fif- een (15) days prior to the date of the public hearing before the City Council on sue roposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at hich time persons appeared in support of the proposal; and, after said hearing, as by the City Council determined that it would be in the public interest, due to changed conditions, that the Zon:ing Ordinance and the Zoning Map be amended in he manner hereinafter set forth in the body of this Ordinance and this Ordinance aving be.en introduced prior to fir~t ~eading hereof, and WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and, after due notice and public hearing and all matters having been one and performed as required by Section 14-A of Zoning Ordinance No. 1695 of he City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code), elating to Specific Use Permits, the City Council finds that due to changed condi ... ions it would be expedient and in the interest of the public health, morals and gen- ral welfare to authorize the granting of a Specific Use Permit as hereinafter set orth; NOW THEREFORE:: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and !the same are hereby amended as follows, to ... wit: K ·EW ZONE CASE NO. 1634 Change the West 64 feet of Lot 11> Block 1~ 34th Street Second Addition~ City of Lubbock~ Lubbock County} Texas, from an "R ... 2" to an 11A-2 11 Zoning District. SECTION 2. THAT the Director of Planning of the City of Lubbock is author- · zed to issue a Specific Use Permit to the Applicant in Zone Case No. 1634 in ccordance with the recommendations and conditions imposed by the Planning and oning Commission, on file with the office of the Director of Planning and the City ouncil, which are hereby adopted and incorporated herein by reference for all pur oses, provided such Applicant agrees to be bound by the terms of the Specific Use ermit~ the granting of which is hereby made subject to compliance to all provisio f Zoning Ordinance No. 1695, an Ordinance of the City of Lubbock~ including parti ularly but not limited to, Section 14-A of Zoning Ordinance No. 1695 within twenty our (24) months of the effective date of this Ordinance, the City \Secretary-Treasur r hall be and is hereby authorized and instructed, upon written notice from the Dir- ctor of Planning that Applicant has not complied with the provisions~ conditions an erms imposed by this Ordinance, to note applican~1 s failure to comply on the mar · f the Minutes of the City Council opposite entry of this Ordinance~ and the authori- ation to issue such Specific Use Permit is hereby revoked, and the Director of lanning in such event is directed to remove from the Zoning Map the legend indicat g such limited use. The Specific Use authorized by this Ordinance is for Prof:e:s onal Type Offices, under provisions of Section 14-A.1-10 of the Zoning Ordinance n the property described in Section 1 hereinabove. SECTION 3. THAT from and after passage and effective date of this Ordinanc aid lots, tracts and parcels of land described in Section 1 hereof shall be changed t he zoning district indicated and the Official Map is amended in accordance herewit SECTION 4. Should any paragraph, sentence, clause, phrase or word of this rdinance be declared unconstitutional or invalid for any reason, the remainder of his Ordinance shall not be affected thereby. SECTION 5.
