HomeMy WebLinkAboutOrdinance - 5765-1969 - Authorizing Altering Of Prima Facie Speed Limit; 20 MPH On 50Th Street - 10/09/1969ORDINANCE NO. 5765 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VEffiCLES ON THE FOLLOWlliG STREET N THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, EXAS, TO-WIT: A 20 MPH SPEED ZONE ON 50TH S'lrn.EET BEGINNING AT A OINT 1901 EAST OF THE CENTER OF UTICA AVENUE (SOUTH SIDE) AND XTENDING WEST FOR 400'; AUTHORIZING THE PLACING OF SPEED LIMIT IGNS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING HAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HERElli SHALL OT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE :SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDI- ANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVID G A SAVINGS CLAUSE; PRESCRIBING A PENALTY AND PROVIDING FOR UBLICATION. WHEREAS, the governing body of the City of Lubbock, as authorized by Article 6701d, Section 169(b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain highways in the vicinity of school areas during periods of ime when the schools are in session and school children are going to and from the schools and playgrounds are different from what is reasonable or safe and should b altered and the immediate preservation of public health1and safety requires immed- iate alteration of said prima facie speed limits as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the prima facie speed limit established by Article 670ld, Section 166(a)(l) _.,. Vernon's Texas Civil Statutes is altered and changed for all ehicles to twenty (2 0) miles per hour during the time the flashing traffic control signal is in operation on the following designated highways or streets in the corpor ate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On 50th Street eginning at a point 190' East of the Center of Utica Avenue (South Side) and extending West for 400'. SECTION 2. THAT the City Manager is authorized and. directed. to cause the placing of signs and traffic eontrol signals so as to clearly define the limits of the prima facie areas set out in this Ordinance, and give notice when such speed limit shall be in effect. SECTION 3. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 4. THAT all highways or streets not specifically set forth in the receding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 5. THAT should any section~ paragraph~ sentence~ clause~ phrase or word of this Ordinance be declared unconstitutional or invalid for any reason~ the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person~ firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction, be fined any sum otto exceed TWO HUNDRED ($200. 00) DOLLARS. SECTION 7. THAT the City Secretary is authorized and directed to cause the ublication of the descriptive caption of this Ordinance together with the penalty revision as an alternative method of publication as provided by law.
