WHEREAS, the City Council finds that after all notices have been given and hear
ings held as provided by law, that it is in the best interest of the citizens of the Cit
of Lubbock to make the change in the zoning law as hereinafter set forth, NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT a new Section 2.12A BE and is hereby added to Zoning
Ordinance No. 1695 of the City of Lubbock which shall read as follows:
11Section 2. 12A -Bar, Saloon or Tavern. A place where alcoholic
beverages are sold for consumption on the premises, with or without
the sale and consumption of food. No dancing permitted. 11
SECTION 2. THAT a new Section 2. 79C BE and is hereby added to Zoning
Ordinance No. 1695 of the City of Lubbock which shall read as follows:
11Section 2. 79C -Nightclub.. A place where food and/or beverages, includ
ing, but not limited to, alcoholic beverages are sold and consumed on the
premises and dancing is permitted. The operation of such business being
conducted in the evening and night hours as contrasted with the daytime
operation of a bar or lounge. 11
SECTION 3. THAT Section 3 of Zoning Ordinance No. 1695 of the City of
Lubbock BE and is hereby amended by re-titling the "C-l II Zoning District to here-
after read as follows:
"C-1 Neighborhood Service District11
SECTION 4. THAT the title of Section 9 of Zoning Ordinance No. 1695 of the
City of Lubbock BE and is hereby amended to read as follows:
"Section 9 -"C-111 Neighborhood Service District11
SE CTION 5. THAT Section 9.1 and the sub-sections thereunder of Zoning
Ordinance No. 1695 of the City of Lubbock BE and is hereby amended to read as
follows:
119. 1 Uses Permitted.
This district is designed to provide an area neighborhood with con
venient services and availability of small items. All businesses
shall be of the retail type and shall be open only during the hours
of 7:00 A. M. to 11:00 P. M. Lights shall be faced or hooded so
that the glare will not annoy area residents. Merchandise for
sale, rent, or display shall not be located more than three (3) feet
from a building.
9.1-1 Any use unconditionally permitted in an 11R11, 11A-l", 1'A-211
or 11AM" District.
9.1-2 Row Dwellings or Townhouses, provided property is platte
and all providions of subsections 7.1-4-2, 7.1-4-3 and
7. 1-4-4 of this Ordinance are complied with.
9.1-3 Antique, ceramic, gift and florist shops, each not occupy-
ing more than four hundred (400) square feet of total floor
area.
9. 1-4 Beauty or barber shops.

9.1-5 Grocery store with not over four thousand (4,000) square
feet of total floor area.
9.1-6 Household appliance sales and repair shop -small
appliances.
9. 1-7 Ice vending station or machine.
9.1-8 Radio and Television repair shops.
9.1-9 Self-service laundry or washateria and dry cleaning 11pick-
up11 stations.
9.1-10 Shoe or boot repair shop.
9.1-11 Studios -art, teaching, dance, music, drama, photograph c,
interior decorating.
9.1-12 Christmas Tree and Christmas Wreath sales from Dec-
ember 1 thru 26th. (Outside business and display permi -
ted provided that all trees and wreaths and signs are not
closer than 10 feet to any street property line and pro-
vided further that all unsold trees, wreaths, and other
items used in conjunction with such sales are removed by
the following January 5th. )
SECTION 6. THAT Section 9. 2 of Zoning Ordinance No. 1695 of the City of
Lubbock BE and is hereby amended to read as follows:
9. 2 Conditional Uses.
The following uses may be permitted when approved by the Zoning
Board of Adjustment in the manner specified in Section 19:
9. 2-1 Any use permitted conditionally in any of the preceding
districts and not otherwise permitted in this district.
SECTION 7. THAT Section l0A.1 of Zoning Ordinance No. 1695 of the City of
Lubbock BE and is hereby amended to read as follows:
l0A.1 Uses Permitted.
It is declared to be the public policy of the City of Lubbock that th
regulations set forth in this district are intended to encourage
orderly development of a high character in attractive landscaped
surroundings with the design of buildings and exterior indications

so controlled as to be more compatible with residential develop-
ment in the vicinity or within the district to preserve property
values and protect the health and welfare of the inhabitants of the
City of Lubbock. No use shall be permitted which will be injur-
ious or offensive to the occupants of the adjacent premises or
area by reason of emission of dust, smoke, odor, glare, noise,
vibration, trash, water spray, or similar causes. All businessE s
shall be those of the retail type only selling new merchandise.
Merchandise for sale, rent, or display shall not be located more
than three (3) feet from a building.

SECTION 9, THAT Section 10, 1 of Zoning Ordinance No. 1695 of the City of
Lubbock BE and is hereby amended to read as follows:
10. 1 Uses Permitted.
The following specified stores, shops, or businesses must be
conducted entirely within a closed building, except when noted,
and shall be permitted only under the following conditions:
No industry or manufacturing shall be permitted except the makin
of articles to be sold at retail on the premises, no killing of
poultry or livestock, and no wholesaling or jobbing shall be
carried on, and no merchandise shall be stored, other than that
to be sold at retail on the premises.
All products produced, whether primarily or incidentally, shall
be sold at retail on the premises and not more than three (3) per-
sons shall be engaged in such production or in the servicing of
materials. This provision shall not be construed to limit the
number of employees engaged in retail activities.
No use shall be permitted which will be injurious or offensive to
the occupants of the adjacent premises or area due to dust, smok ,
odor, noise, vibration, glare, trash, water spray, or other s im-
ilar causes. Merchandise for sale, rent, or display shall not be
located more than three (3) feet from a building, except where
indicated after the listed use.

Lubbock BE and is hereby amended to read as follows:
10. 2 Conditional Uses.
The following uses may be permitted when approved by the Zonin
Board of Adjustment in the manner specified in Section 19.
10.2-1 Boat sales (Outside display and sales permitted with
no restrictions).
SECTION 11. THAT Section 11. 1 of Zoning Ordinance No. 1695 of the City of
Lubbock BE and is hereby amended to read as follows:
11. 1 Uses Permitted.
The following uses shall be permitted only under the following
conditions. There shall be no manufacture, compounding, pro-
cessing or treatment of products other than that which is clearly
incidental and essential to retail stores or businesses and where
all such products are sold at retail on the premises; and
Such uses, operations, or products shall not be objectionable,
due to odor, dust, smoke, gas, noise, trash, vibration, glare,
water spray or other similar causes; and
All business must be conducted entirely within a closed building
except where otherwise provided below. Merchandise shall not
be located more than three (3) feet from a building except where
indicated after each listed use.

turing or industrial operation shall not disseminate dust, fumes
gas, noxious odor, trash, smoke, glare or other atmospheric
influence beyond the boundaries of the property on which such
use is located, and which produces no noise exceeding in inten-
sity at the boundary of the property the average intensity of
noise of street traffic at that point, and provided that such use
does not create fire hazards on surrounding property.

SECTION 16. THAT Section 13. 2 of Zoning Ordinance No. 1695 of the City
of Lubbock BE and is hereby amended to read as follows:

Any use listed in the "M-2 11 District may be permitted, subject
to approval by the Zoning Board of Adjustment in the manner
specified in Section 19, upon the additional finding that such
manufacturing or industrial operations shall not disseminate du ,
fumes, gas, noxious odor, smoke, glare, or other atmospheric
infl. uence beyond the boundaries of the property on which such

SECTION 19. THAT Section 14-A.1 of Zoning Ordinance No. 1695 of the City
of Lubbock BE and is hereby amended by adding thereto a new sub-section
14-A. 1-18 which shall hereafter read as follows:
1114-A. 1-18 Athletic field, Park, stadium, arena --commercial, on a
site of ten (10) acres or more at the time of application, in any district".
SECTION 20. Should any section, paragraph, sentence, clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby ..
SECTION 21. THAT the City Secretary is hereby authorized to cause publica-
tion of the descriptive caption of this Ordinance as an alternative method provided
by law.
