AN ORDINANCE AUTHORIZING THE ALTERING• AND CHANGING OF THE
PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON THE FOLLOWING STREET
IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK. LUBBOCK COUNTY.
TEXAS. TO-WIT: A PORTION C?F PARKWAY DRIVE (u.s. 82) ANDA PORTION
OF U.S. HIGHWAY 62 AT THEIR INTERSECTION WITH LOOP 289 AND EXTEND-
ING NORTHWARD ON A PORTION OF IDALOU HIGHWAY; A PORTION OF LOOP
289 EXTENDING FROM SUCH INTERCHANGE TO F.,M.1 HIGHWAY 40; AUTHOR-
IZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PR
VIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY
SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVlSIONS HEREOF
AND THAT TH1S ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA
FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFIC ..
ALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR T
EFFECTIVE DATE OF THlS ORDINANCE.
WHEREAS., the governing body of the City of Lubbock, as authorized by Art ..
icle 6701d, Section 169(b) Vernon's Texas Civil Statutes., finds that certain prima
facie speed limits on certain_ highways are different from what is reasonable or saf
and should be altered due to construction on the portions of the highways stated
hereinabove. NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limit established by Article 6701d,
Section 166{a)(l) Vernonts Texas Civil Statutes is altered and changed for all veh ..
icles on the following designated highways or streets in the corporate limits of the
City of Lubboc}{, Lubbock County., Texas, as more particularly described, to ... wit:
A 35 MPH Speed Zone on both eastbound and westbound lanes of East
4th Street (F. M. 40), beginning at highway station 34, approximately
250 feet west of Linden Avenue., extending East to highway station 47,
approximately 250 feet East of Niter Avenue;
A 35 MPH Speed Zone on both northbound and southbound lanes of Loop1
289, beginning at highway station 585., approximately 1000 feet South
of East 4th Street, extending north ... northwest to highway station 49 5,
approximately 750 feet south of Erskine Road;
A 35 MPH Speed Zone on both northbound and southbound lanes of Idalou
Highway (U.S. 62), beginning at highway station 125, appr~mately 250
feet North of East 4th Street, extending nttrtheast to highway station 198.,
approximately 500 feet south of Erskine Road;

A 35 MPH Speed Zone on both eastbound and westbound lanes of Parkwa
Drive., (U. s. 82), beginning at highway station 328., approximately 100
feet East of Guava Avenue., extending East to the intersection with the
Idalou Highway (U.S. 62).
(The above Speed Zones will also be established by the Texas Highway
Commission to remain in effect during construction within such portions
of highway.)
SECTION 2. The City Manager is authorized and directed to cause the placin
of signs so as to clearly define the limits of the prima facie areas set out in this
Ordinance.
SECTION 3. Any person, firm or corporation violating the prima facie speed
limit established by this Ordinance shall., upon conviction., be fined any sum not to
exceed TWO HUNDRED & NO/100 ($200. 00) DOLLARS.
SECTION 4. The City Secretary is authorized and directed to cause the pub ...
lication of the descriptive caption of this Ordinance together with the penalty as an
alternative method of publication as provided by law. This Ordinance shall becom
effective ten (1 O} days after the date of its last publication.
SECTION 5. THAT all Ordinances or parts of Ordinances conflicting with an
of the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION 6. THAT all highways or streets not specifically set forth in the p ...
ceding sections shall not be affected by the provisions hereof. and this Ordinance
shall be cumulative of all other prima facie speed limit Ordinances except those
with which it specifically conflicts.
SECTION 7. Should any section, paragraph. sentence, clause, phrase., or
word of this Ordinance be declared lunconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
