HomeMy WebLinkAboutOrdinance - 3681-1961 - Amending Ordinance 1695 To Change: Zone Case 935 - 12/14/1961~ 3681 Amended by Ordinance No. 4555 ORDINANCE NO. 368l ---- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWIN CHANGE: ZONE CASE NO. 935 : CHANGE LOTS 1, 2, AND THE EAST 90 FEET OF LOT 3, BLOCK 11 WEST GATE DRIVE ADDITION INSTALLMENT NO. _ 1, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM AN "R-1" TO A 11 C-311 ZONING DISTRICT. (SAID PROPERTY BEING LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF 19TH STREET AND QUAKER A VENUE); SUBJECT TO CONDITIONS. .. WHEREAS, the proposed change in zoning districts has been duly presented to the Zoning and Planning . Commission for its recommendation, which was received by the City Commission and after due consideration, the City Com- mission finds thatmaking the proposed change as hereinafter set oqt will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 10llf, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen {15) days prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the Assembly Room oftr.e Central Fire Station Building located at 503 Avenue K in Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 935 : Change Lots 1, 2, and the East 90 feet of Lot 3, Block 1, West Gate Drive Addition Installment No. 1, an Addition to the City of Lubbock, Lubbock County, Texas, from an "R-1'1 to a "C-311 zoning district. (Said property being located at the Northwest corner of the intersection of 19th Street and Quaker Avenue); Subject to the following conditions: 1. That the property be used for shopping center purposes only, with the uses permitted being those permitted "unconditionally" in the "C-2" Local Retail District, except for the following: Churches and other places of worship, including parrish houses and Sunday Schools. Boarding and lodging houses. Convalescent homes. Day nursery. Apartment hotels. Multi -family dwellings and apartment houses. Public parking area. Hospital, health institution, clinics, or sanitariums. Schools fPrivate, elementary, high, college & universities). Institutional homes. Children's nursery or kindergarten. Private clubs, lodges, fraternities, sororities, and dormitories. Swimming school. Archery range, commercial. Athletic Club. l • ! r t c.~ ... t>r Banks. Bowling alleys •. Commercial parking garages. Commercial schools. Furniture upholstery. Laundry or self service or washateria iri nature. Pet shops. Pest control services. Refr-igeration service. Theater and moving picture show. Water sales. 2. The North and West side of the property where not occupied by a build- ing shall be screened by a solid screening fence of masonry or pipe / .. u columns supporting wood stockade type panels. The height of said screening fence along the North side of the property shall be 6 feet, and the height! of the fence along the West side of the property shall be six feet beginning at the North property line extending approxmiately 84 feet South to a point then said fence shall be 5 feet in height . from said point extending South approximately 30 feet to a point, then said fence shall be five feet in height from said point extending Southeasterly approximately 45 feet to a point, then said fence shall be 3 feet in height extending South approximately 120 feet to a point in the South property line. 3. That all garbage and trash storage be handled on the property and not from the alley. 4. That the alley be paved. 5. That the building be single story in height with a minimum set- back of 180 feet from 19th Street and 40 feet from Quaker Avenue. 6. That the major service area at the east end of the building and adjacent to Quaker Avenue occupying the 40 feet set-back above- mentioned in condition 5 be screened along the North 80 feet of the East property line except for driveway opening with a solid 6 feet screening fence of masonry or pipe columns supporting wood stock- ade type panels. 7. That the area between the 19th Street property line and the South wall of the building be devoted to off-street parking, with provisions for necessary sidewalks, landscaping and parking area improvements. 8. That any lighting be so designed as to not cast any glare on adjacent residential properties. 9. .That a single identification sign for the shopping center be per- mitted in the landsc;~ped plot at the intersection of 19th Street and Quaker Avenue and not closer than 5 feet to either street property line; such sign may be flood or spotlighted and shall not be over 6c(.i square feet in area or 16 feet in height with the bottom of such sign a minimum of eight (8) feet above ground level, and shall not con- stitute a vision obstruction at said intersection. All other signs within the shopping center for identification of the individual occupancies shall be attached to and flat against the wall of the building or to the front edge of any canopy and shall not project above the roof line of the building and the lighting of such signs shall not be flashing or . animated and shall not be such as to cast glare in any of the adjacent properties. 10. All driveways and access to the property shall be approved by the City Traffic Engineer in conformance with existing ordinances regulat- ing same. l . 11. That no access to stores or shops be permitted from the alley. The above set forth cond~tions apply in jhis zone change only and the pro- perty with which this Ordinance is concerned, and shall not be construed as a repeal or amendment of Zoning Ordinance No. 1695 as applied to any other pro- perty in the City of Lubbock. SECTION 2. THAT from and after passage and effective date of this Ordinance, said Lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith.
