ELECTRIC LIGHT BONDS, SERIES l.951", DATED JUNE 1., 1955- THE STATE OF TEXAS I CITY OF LUBBOCIC COUNTY OF LuBBOCK ON THIS, the 2gth day ot _ __,~M~&YW'---·" 195!, the City Commission or the City of Lubboc~, Texas, convened in ~spe~c·ia-1._ ___ session, at the regular meeting place thereof in the City Hall, with all members thereof present, to-wit: MURRELL R. TRIPP., HURLEY CARPENTER l HARRY MORRIS LUCIAN THOMAS L. E. DAVIS and MRS. LA VENIA LOWE., MAYOR., Presiding; COMMISSIONERS, CITY SECRETARY, also being present; constituting a quorum, at which time the following, among other business, was transacted, to-wit: Commissioner ~---~T~h~om~&~~~-presented tor the considera- tion or the City Commission an ordinance ratifying, confirming and approving an ordinance duly passed and adopted by the City Commission of said City on April 24, 195~, authorizing the issuance of $1~5,000 "CITY OF LUBBOCK., TEXAS, WATER, SEWER AND .. . . . ~ ELECTRIC LIGHT BONDS~ SERIES 195t" 1 dated June l, 195.,1 (being . . the fourth and final parcel or installment of a total voted authorization or $6,058,000 bonds). The ordinance was read in full by the City Secretary. Thereupon, Commissioner Carpenter moved that the rule requiring that no ordinance shall be passed on the day on which it is introduced be suspended, and that in view or the emergency set forth and defined in the preamble to the proposed ordinance, that the same be declared an emergency mea~e. This motion was duly seconded by Commissioner motion carried by the following vote: _ _.:-.:l>i~or~r..aioli.s __ • The AYES: Mayor Tripp and Commissioners Carpenter, Morris, Thomas and Davis. NOES: None. Thereupon, Commissioner ----~Th~oma~s~ ____ -moved that the ordinance as read in full by the City Secretary be finally passed and adopted by the Cou:mission. This motion was seconded by Commissioner ______ D_a_v.L.·s*---" and the motion, carrying with it the final passage and adoption or the ordinance, was unanimous- ly carried by the following vote: AYES: Mayor Tripp and Co~ssioners Carpenter, Morris, Thomas and Davis. NOES: None. Thereupon, the Mayor announced that the ordinance had been finally passed and adopted by unanimous vote of the Com- mission, in accordance with the requirements of Sections 15, 16 and 17, of Article IX or the Lubbock Charter; and the Mayor thereupon signed and approved the ordinance in the presence or the Commission. The ORDINANCE is as follows: NO. 1397 "AN ORDINANCE by the City Commission of the City of Lubbock, Texas, ratifying, confirming and approving an ordinance duly passed and adopted as an emergency measure by the City Commission of said City on April 24, 1953, authorizing the issuance of $145,000 •CITY OF LUBBOCK, TEXAS, WATER, SEWER AND ELECTRIC LIGHT BONDS, SERIES 1953', dated June~ .. 1953 (being the fourth and final parcel or installment of a total voted authorization of $6,058,000 bonds); enacting provisions incident· and relating to the subject and purpose of this ordinance; and declaring an II emergency. ( P, t'l"';/ trJ... ) ; 17) WHEREAS, heretofore, to-wit: on the a4th day of April, 1953, the City Commission of the City of Lubbock, Texas, duly passed and adopted an ordinance as an emergency measure, authorizing the issuance of "CITY OF LUBBOCK, TEXAS, WATER, SEWER AND ELECTRIC LIGHT BONDS, SERIES 1953t', in the principal sum of $145,000 (oeing the fourth and tinal .parcel or install- ment of a total voted authorization of $6,058,000 bonds), and which ordinance is duly recorded in Book 11, page ~ et seq., of the Minutes of said City Commission, said ordinance being NO. 1377 nAN ORDINANCE by the City Commission of the City of Lubbock, Texas, authorizing the issuance of bonds in the principal sum of $145,000 (being the fourth and final parcel or in~tall­ ment of a total voted authorization of $6,058,000 bonds), for the purpose of making permanent public improvements, to-wit: con- structing improvements, enlargements, exten- sions and repairs to the City's Waterworks , System, Sanitary Sewer System and Electric ,Light System; prescribing the form of the bonds and the rorm or interest coupons; levying a continuing, direct annual ad valorem tax on all taxable property within the limits of said City to pay the interest on said bonds and to create a sinking fund for the redemption thereof~ and providing for the assessment and collection of such taxes; enacting the provisions incident to and relating to the purpose and subject of this ordinance; and declaring an emergency~11 AND WHEREAS, Section 16 of Article IX of the Charter of the City of Lubbock>, Texas, provides "No ordinance, unless it shall be declared to be an emergency measure, and passed by a unanimous vote or the Commission, shall be passed on the day on which it shall be introduced."; and WHEREAS, one member of the City Commission being absent on April 24, 1953, this City Commission now deems it necessary and proper to ratify, confirm and approve said ordinance passed on April 24, 1953; and WHEREAS, 1 t is FOUND 1 DETERMINED AND ADJUDGED that . . it is necessary and to the best interest or the City to provide . funds for the purpose of constructing improvements, enlargements, extensions and repairs to the City•s Waterwor~s System, Sanitary Sewer System and Electric Li·ght.t System at the earliest possible date, for the immediate preservation or the public peace, pro- perty, health and safety or the citizens or the City of Lubbock, Texas, and that by virtue thereof this ordinance should be .. passed and adopted as an emergency measure; therefore BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: That the ordinance by the City Commission of the City or Lubbock, Texas, authorizing the issuance of $145,000 "CITY OF LUBBOCK,. TEXAS, WATER, SEWER AND ELECTRIC LIGHT BONDS, SERms 1953u, dated June 1, 1953 (being the fourth and final parcel or installment of a total voted authorization of $6,058,000 bonds), be, and the same is hereby RATIFIED, CON- FmMED AND APPROVED. SECTION 2: BE IT FURTHER ORDAINED BY THE CITY COM- . ' MISSION OF THE CITY OF LUBBOCK: The public importance of this measure, and the fact that it is to the best interest of the City to provide funds for the purpose of constructing improvements, enlargements, extensions and repairs to the City•s Waterworks System, Sanitary' Sewer System and Electric Light System at the earliest possible date, for the immediate preservation of the public peace; pro- perty~ health and safety or the citizens of the City of Lubboc~, constitute and create an emergency and an urgent public nec~s­ sity, requiring that this ordinance be passed and take effect as an emergency measure, and that this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage.
