V~S, the City Commission'finds that numerous curbs, sidewalks and driveways are being constructed, reconstructed and repaired for commercial use without due consideration for pedestrian's use of sidewalks or the location of driveways with respect to vehicular traffic along the streets, highways and alleys, and it is deemed necessary in the public interest to regulate such con-struction, to promote public safety and urohibit unwarranted destruction of public property, THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT, no person, firm or corporation shall construct, recon-struct, alter,· repair, remove or replace any sidewalk or driveway or curb or combination of curb and gutter on anr public property vnthin the City of Lubbock without first obtaining from the Building Inspector a permit so to do, and all such persons shall construct, reconstruct, alter, repair, remove or replace said sidewalks, driveways,curbs or combination of curbs and gutters under the super-vision of the Building Inspector and in accordance with specifications herein• after provided for, or such other specifications as may be approved by the City Engineer and adopted by the Governing Body. SECTION 2. THAT, all applications for the construction, reconstruction and repair of sidewalks, driveways, curbs and combination curbs and gutters shall be in writing with a plat made a part of said application, showing the location, specifications and other proposed construction, reconstruction or repair pro-uosed to be done by the onwer of abutting property, or his duly authorized agent. SECTION 3. TF~T, when any such written application has been submitted to the Building Inspector and the plan of the proposed improvement conforms to ti1e general specifications shown by the STANDARD DESIGNS FOR COMMERCIAL DRIVE',AYS IN THE CITY OF LUBBOCK designated as Plate 11 or Plate 2, or Plate 3, or Plate 4, which designs are hereby auproved and adopted for driveways incident to com-mercial use of property, the Building Inspector is authorized to issue a permit "( V· 0 SECTION 4. THAT, where a~ such application discloses that the proposed improvement does not co~£orm to. the designs adopted in the next preceding Sec• tion, and made a part of this Ordinance, the Building Inspector shall submit said application to the City Engineer and the City Commission for consideration, and unless said application is approved by the City Commission, the Building Inspector shall not issue a permit for such construction, reconstruction or re-pair indicated by said application. SECTION 5, THAT, all applications for permits provided for by this Ordinance shall be accompanied by a cash fee of Two ( $2.00) Dollars payable to the Building Inspector, who shall duly deposit same to the credit of the City of Lubbock. SECTION 6. THAT, it shall be unlawful for any person to construct, reconstruct, remove, break or destroy any curb, sidewalk, driveway or combination curb and gutter, or any part of any curb or gutter or sidewalk or driveway or combination curb and gutter located upon the right-of-vmy of any highway, street of alley within the corporate limits of the City of Lubbock, unless the owner or his duly authorized agent shall make application for, and the Building In· spector shall have issued a permit therefor in accordance with the provisions of this Ordinance. SECTION 7. THAT, any person who violates any provision of Section Six (6) of this Ordinance shall, upon conviction, be fined in any sum not exceeding Two Hundred ($200.00) Dollars. \.
