FIRE DEPARTMENT, PARI'ICIPATE IN SUCH SYSTEr.i; Al'ID ACCEPI'Il~ ALL OF THE OBLIGATIOUS AliD BENEFITS OF SUCH SYSTEM. WHEREAS, the Constitution of the State of Texas nas amended on November 7, 1944, ~ the addition of Section 51-f, Article III, which authorized the Legis- lature to establish a State~de retirement and disability pension system for city employees; l't11EF.EAS, the 5oth Legislature of the State of Texas enacted House Bill :29 by Parkhouse, lmown as the Texas Municipal Retirement System and being Article 6:243h of Vernon1s Annotated Civil statutes, which authorizes the governing bo~ of each city or town to elect, at its option, to ha~e one or ~ore ot the city departments participate in such system, and, VrnEP~, municipal emplqyees are not covered by Federal Social Securit,r, the governing body of the City of Lubbock, Texas, finds that it idll be in the public interest for the city to have its employees participate in the Texas l~cipal Retirement System, now THEREFORE; BE IT ORDAINED BY THE CITY cor.IMISSION OF THE CITY OF LUBBOCK: SECTION 1: THAT, on behalf of the City of Lubbock, Texas, the City Com- mission hereb,y ~v.ercises its option and elects to have the city and all of the emplqyees of all departments, except the Fire Department, participate in the Texas ~~cipa1 Retirement System as provided in House Bill :29, Chapter 75, Page 108, Acts of the 5oth Legislature in 1947, being Article 62L0h of Vernon 's Annotated Civil Statutes, and all of the benefits and obligations of such system are here~ accepted • SEm'ION :2: THAT, the Mayor is hereby directed to notify the Board of Trustees of the Texas ~cipal Retirement System that the City of Lubbock, Texas, has elected to participate and have the empla.yees of the following city de?artments ~articipate in such system& DEPARl'MEI-1l'S t; l\ ;. ',.f, I '( City Secretary Tax Auditing Personnel Purchasing Legal \7arehouse Water and Light Office Shop Airport Public Works Engineering Building Inspection Police Health Sewage Treatment ' ~. -----=-=-~~~·~----======----------======-=====--====~==== - - -,._...-, DEPARI' i.!ENTS Garbage Recreation Building r~aintenance Cemetery Street and Tiater Electric Corporation Court Park SECTION J: Each person who becomes an employee of a~ participating depart- ment on or after the effective date of participation of such department shall be included ~ithin and subject to the provisions of the Te~~s Municipal Retirement System beginntng upon the date such person becomes an "employee," as defined in Sub-section 11~, Section 2, of such system. SECTION 4: THAT, the City of Lubbock, Texas, may in the future refuse to add new departments or· new employees to such system, but shall never discontinue as to any participants. SECTION 5: THAT, the City Secretar,y is hereb,y directed to remit to the Board of Trustees of the Texas lfunicipal Retirement System, at its office in Austin, Texas, the City's proper contributions to the system and the amounts which shall be deducted from the cocpensation or payroll of employees, all as required by said Eoard Ullder the provisions of Chapter 75, Act of the 5oth legislature of the State of Texas, 1947, and the said City Secretary is hereb,y authorized and directed to ascertain and certify officially on behalf of the City of Lubbock, Texas, the prior service rendered to the said municipality b,y each of the employees of the participating departments, and the average prior service com- nensation received b,y each, and to make and execute all other reports and 1 certificates which may be required of the City of Lubbock, Texas, under the pro- visions of Chapter 24, Acts Regular Session 5oth Leeislature or the r~les and re~~lations of the Board of Trustees of the Texas Iaunicipal Retirement System.
