AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF LUBBOCK, BEING THE ELECTRICAL CODE, BY AMENDING SECTION llA-5(1) ADOPTING THE NATIONAL ELECTRICAL CODE (NFPA NO. 70-1978) 1978 EDITION AND AMENDING SECTICN llA-82 ESTABLISHING A FEE SCHEDULE FOR ELECTRICAL PERMITS, REPEALING CCNFLICTING ORDINANCES TO THE EXTENT OF SUCH CCNFLICT, PROVIDING A SAVINGS CLAUSE, PROVIDING fOR A PENALTY AS PROVIDED IN SECTICN 1-5 OF THE CITY CODE AND PROVIDING FOR PUB LI CATI ON. WHEREAS, the City Council for the City of Lubbock finds it to be in the best interest of the citizens of Lubbock to make the following changes in the Electrical Code, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTICN 1. THAT Chapter llA of the Code of Ordinances, City of Lubbock, (Being the Electrical Code), BE and is hereby amended by amending sub-section (1) of Section llA-5 thereof to read as follows: "(1) 1978 Edition, National Electrical Code (NFPA No. 70-1978) as adopted by the National Fire Protection Association, which is hereby adopted and made a part hereof as though fully copied herein and as filed with the City Secretary of the City of Lubbock; provided however, Section 210-8 and 215-9 are hereby deleted". SECTION 2. THAT Section llA-82 of Chapter llA of the Code of Ordinances, City of Lubbock, BE and is hereby amended by amending the first paragraph thereof to read as follows: "The following fees shall be charged by the City and must be paid before a permit for electrical work on all new construction is issued or work thereon is done: The permit fee shall be equal to one and one quarter cent ($0.0125) per square foot of floor space in the con- struction as planned. When more than one inspection is required, a re-inspection fee of ten ($10.00) for each re-inspection will be charged. If the owner is doing his own work, the inspection fee is payable in advance. Provided however, new warehouses shall pay the following fees: 1,000 to 20,000 square feet, $0.0125 of a cent per square foot; 20,001 to 50,000 square feet, $0.0075 of a cent per square foot plus two hundred-fifty ($250.00) dollars; 50,001 and up square feet, $0.0025 of a cent per square foot plus four hundred seventy-five ($475.00) dollars. Exception: For new warehouses with no offices or restrooms and with. 120-240 volt, single phase 60 amp maximum service the following fees shall be paid. 0-1000 square feet, one and one-half cent per square foot. 1001 and up square feet, $1.00 per outlet and $1.00 per fixture, plus fifteen dollars. In all instances, a minimum fee of ten ($10.00) dollars shall be charged for any permit." .., ·• 'LGB :cl .~ SECTION 3. THAT all Ordinances or part of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflicts exists. SECTION 4. THAT should any section, paragraph, sentence, clause, phtase or word of this Ordinance be declared unconstitutional or invalid for any:: reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT violation of any provisions of this Ordinance shall ibe deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Seciton 1-5 of the City Code. SECTION 6. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provtded by law. AND IT IS SO ORDERED.
