AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF LUBBOCK, BY AMENDING THE APPENDIX-ZONING ORDINANCE THERETO; PROVIDING FOR A DEFINITION OF A "HOUSE, ZERO LOT LINE"; PROVIDING FOR ZERO LOT LINE HOU.SES AS A SPECIFIC USE PLANNED UNIT D.EVELOPMENT IN ANY ZONE DISTRICT; PROVIDING FOR YARD REQUIREMENTS; LOT WIDTH; PROVIDING FOR LOT AREA; PROVIDING FOR LOT COVERAGE; PROVIDING FOR A HEIGHT LIMIT; PROVIDING FOR OFF-STREET PARKING; PROVIDING FOR LOT ACCESS; PROVIDING FOR FENCING; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council for the City of Lubbock, Texas, after receiving the recommendation of the Planning and Zoning Commission, finds that it would be in the interest of the citizens of the City of Lubbock to make the changes in the law as hereinafter set-forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF LUBBOCK: SECTION 1. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be numbered 2.58a, which said section reads as follows: "HOUSE, ZERO LOT LINE: A residence allowed to have little or no side yard on one side, where the wall on that side has no doors, windows or other openings and which otherwise qualifies for a one-hour fire rating as defined in the bu:i.lding code." SECTION 2. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7, which said section shall read as follows: "Zero lot line houses in any residential district, subject to the follow- ing conditions:" SECTION 3. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-1, which said section shall read as follows: "YARD REQUIREMENTS." SECTION 4. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-1-1, which said section shall read as follows: "FRONT YARD. The minimum front yard shall be fifteen (15) feet, provided that in no case shall a garage or carport fronting onto a street be within twenty (20) feet of the street property line." SECTION 5. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-1-2, which said section shall read as follows: "REAR YARD. The minimum rear yard shall be fifteen (15) feet, except that acme story wing or extension may be built to within five (5) feet of the rear property line." SECTION 6. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-1-3, which said section shall read as follows: . "SIDE YARD. There shall be no side yard requirements for one side of the house;~ever, the other side yard shall be a minimum of ten (10) feet, five (5) feet of which shall be an access easement for adjoining property · maintenance. No doors, windows or other openings shall be permitted on Zero (0) lot line side of houses. All corner lots shall have a minimum of ten (10) feet side yard adjacent to a street. SECTION 7. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-2, which said section shall read as follows: "LOT WIDTH. The minimum width of any development lot shall be thirty- five (35) feet. SECTION 8. THAT the Zoning Ordinance -in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-3, which said section shall read as follows: ''LOT AREA. The minimum area of any development lot shall be twenty-eight hundred (2,800) square feet." SECTION 9. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-4, which said section shall read as follows: "LOT COVERAGE. The combined area of all structures shall not exceed sixty-five (65) percent of the lot area. Trellised and open porches shall not be counted in the combined area." SECTION 10. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-5, which said section shall read as follows: "HEIGHT LIMIT. Buildings designed for residential occupancy shall not exceed two (2) stories and shall not exceed thirty-five (35) feet in height. Detached garages and other accessary buildings shall not exceed the height of the primary unit." SECTION 11. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-6, which said section shall read as follows: "OFF STREET PARKING. Single family dwellings shall have a minimum of two (2) approved parking spaces." SECTION 12. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be amended by adding a section, to be num- bered 22.3-1-7-7., which said section shall read as follows: "ACCESS. All lots shall have access either to a public street or to a private street meeting city street construction standards." I ' .. 4~-·. ·~ ··~ . SECTION 13. THAT the Zoning Ordinance in the Appendix of the Code of Ordinances for the City of Lubbock be·amended by adding a section, to be num- bered 22.3-1-7-8, which said section shall read as follows: "FENCING. Any front yard fencing shall be shown on site plan." SECTION 14. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable QY a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 15. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 16. THAT the City Secretary is hereby authorized to cause publication of the descrinti•7e caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
