AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING
THE ZONING CODE, BY CREATING A HISTORIC LANDMARK DISTRICT CONTAINING EIGHT
LANDMARKS, SAID DISTRICT AND LANDMARKS BEING MORE PARTICULARLY DESCRIBED IN
THE BODY OF THIS ORDINANCE; ESTABLISHING STANDARDS FOR THE DISTRICT AND THEIR
LANDMARKS; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY
CODE; PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council for the City of Lubbock, after having received
the recommendations of the Urban Design Commission and the Planning and Zoning
Commission, and having held all public hearings as required by law, finds that
it would be in the interest of the citizens of the City of Lubbock to make the
changes in the law as hereinafter set-forth: NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF LUBBOCK:
ZONE CASE NO. 2243
SECTION 1. THAT the Design-Historic (D-H) Zoning district classification
be added as an overlay zone to the zoning existing on the property described
below, so as to make the same into a Historic Landmark District:
Change all of Overton Addition, lying south of Broadway and West of
Avenue Q, save and except the easternmost 147.5 feet, the northernmost
120 feet, the southernmost 127.5 feet, Overton Addition lying south
of Broadway and west of Avenue Q, and save and except the south 120
feet of Block 55, the north 127.5 feet of Block 54, the east 336.5
feet of the north 127.5 feet of Block 73, the south 120 feet of the
Block 72, the west 250 feet of the south 120 feet of Block 84, the
west 235 feet of the south 120 feet of Block 100, the west 300 feet
of the north 127.5 feet of Block 101, the west 200 feet of the south
127.5 feet of Block 101, the west 250 feet of the north 127.5 feet
of Block 102, the west 200 feet of the south 127.5 feet of Block
102, the west 375 feet of the north 185.8 feet of Block 103, the
west 200 feet of the south 185.8 feet of Block 103, all in said
Overton Addition; and Lots 1 thru 14, Block 2 and Lots 1 thru 14,
Block 1, Hankins Addition; and the south 147·. 5 feet of Block 48,
Overton Addition; and the north 20 feet of Lot 12, Block 5, Overton
Addition; and the north 27 feet of the west half of Lot 8, Block 11,
Overton Addition all in the City of Lubbock, Lubbock County Texas.
SECTION 2. THAT the following regulations shall apply to all properties
within said district which is not herein designated as historic landmarks:
1. NEW BUILDINGS
A. Any new structure which is the main structure on the
development lot shall be architecturally compatible
with the historic landmark structures therein (Tudor,
Mission, Spanish Colonial Revival, Georgian Revival,
Victorian, Modern, Spanish Renaissance Revival), or
shall be architecturally compatible with the Bungalow
or Federal Revival styles, in terms of style, color,
materials, texture, and basic form as found in said
historic landmark structures or as described in the
booklet "Architecture in Lubbock: A Guide to Identi-
fication and Preservation", First Edition, 1979.

B. Any new accessory building in excess of 100 sq. feet of floor
area shall be compatible with the main structure on the same
development lot.
C. Any new structure which is the main structure on the development
lot shall be substantially unique in design and form and be
clearly distinguishable visually from any other structure in
this district and must contribute to the diversity of architec-
ture which is a characteristic of this district.
2. ALTERATIONS TO EXISTING STRUCTURES
A. Alterations to existing structure shall be architecturally
compatible to the existing structure in terms of style,
color, materials, texture, and basic form as found in said
structure and shall be compatible with existing structure
in the same block. Nothing herein shall be construed to
prevent the installation of aluminum storm doors or storm
windows, solar heat collectors, skylights, or iron porch
rails.
3. LANDSCAPING STANDARDS
A. The open expanse across the front of the lot located between
the facade of a structure and the front of the lot shall be
landscaped in lawn grass or other living plant materials,
except that a sidewalk leading to the structure and a driveway
leading to a garage or carport shall be permitted in this
open expanse. The Urban Design Commission may waive this
provision as it applies to entirely new apartment buildings
containing four or more units that are constructed in the
future in the A-1 DH District. In the event of a hardhsip,
fences that are compatible with the main structure may be
permitted within this landscaped expanse by the Urban Design
Commission. Vehicles shall not be permitted to park on any
expanse in this district that is required to be landscaped.
B. The parkway shall be landscaped with lawn grass or other
living plant material or be paved with brick.
C. The owner of any development lot in this district shall,
within a reasonable period of time, remove any dead tree
from the development lot or the adjoining parkway and
"knobing" of landmark trees shall be prohibited.
4. AIR CONDITIONING STANDARDS
A. Evaporative type air conditioners shall not be permitted
on the front wall or front roof gable of a structure unless
otherwise permitted by the Urban Design Commission.

SECTION 4. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
as provided in Section 1-5 of the City Code.
SECTION 5. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 6. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
