WHEREAS, the City Council, after receiving the recommendations of the Planning and Zoning Commission, has determined that the existing definitions and regulations pertaining to sign control, as contained in Ordinance No. 7084 are no longer sufficient to achieve the purposes for which they were intended; and -2- '• LGB:lb WHEREAS, the City Council finds that after all notices have been given and hearings held as provided by law, that is is in the best interest of the citi- zens of the City of Lubbock to make the change in the zoning law as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2.14 of Zoning Ordinance No. 7084 of the City of LUbbock, BE and is hereby amended to read as follows: "Section 2.14 BILLBOARDS: Any structure or portion thereof upon which are outdoor advertising signs which advertise, promote or otherwise disseminate information pertain- ing to goods, products or services, including chari- table services or appeals and political services or appeals, and which are not related to goods, products or services comprising a primary use on the premises on which the sign is located, being either: 1) Poster panels or bulletins normally mounted on a building wall or free-standing structure with advertising copy in the form of pasted paper; or 2) Multi-prism signs -same as above, and alter- nating advertising messages on the one display area; or 3) Painted bulletins, where the advertiser's mes·- sage is painted directly on the background of !· a wall-mounted or free-standing display area." SECTION 2. THAT Section 2.105 of Zoning Ordinance No. 7084 of the City of ~ubbock, BE and is hereby amended to read as follows: "Section 2.105 SIGN: Any words, numbers, figures, devices, designs, trademarks or other symbols, which attract attention to or make known such things as an individual, firm, profession, business, commodity or service, and which is visible from any public street. This definition of "sign" shall include any structure designed to be used for said display. For the purpose of removal, "sign" shall also include sign supports." SECTION 3. THAT a new Section 2.105(a) BE and is hereby added to Zoning prdinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(a) SIGN, ABANDONED: Any sign, including off-premise signs unless owned and operated by a bona fide - 3 - ~GB:lb bill board company, which no longer correctly directs or exhorts any person or advertises a bona fide business lessor, owner , product, ser- vice, or activity." SECTION 4. THAT a new Section 2.105(b) BE and is hereby added to Zoning ~rdinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(b) SIGN, ADVERTISING VEHICLE OR TRAILER: Any vehicle or trailer, which has as its basic pur- pose the advertisement of products or direction of people to a business or activity, whether lo- cated on or off-premise." SECTION 5. THAT a new Section 2.105(c) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(c) SIGN AREA: The area of any free-standing sign or billboard shall be the sum of the areas en- closed by the minimum imaginary rectangles, tri- angles, or circles which fully contain all ex- tremities of the sign, including the frame but excluding any supports. Sign area for all other signs shall be the sum of the areas of the mini- mum imaginary rectangles, triangles, or circles which fully contain all words, numbers, figures, devices, designs or trademarks by which anything is made know. " SECTION 6. THAT a new Section 2.105(d) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(d) SECTION 7. THAT Ordinance No. 7084 of "Section 2.105(e) SECTION 8. THAT Ordinance No. 7084 of "Section 2.105(£) SIGN, AUXILIARY: Any sign indicating general in- formation, such as pricing, trading stamps, credit cards, official notices or services required by law, trade associations, and signs giving direc- tions to offices, rest rooms, exits and like fa- cilities." a new Section 2.105(e) BE and is hereby added to Zoning the City of Lubbock which shall read as follows: SIGN, BILLBOARD: (See section 2.14). " a new Section 2.105(f) BE and is hereby added to Zoning the City of Lubbock which shall read as follows: SIGN, CANOPY: Any sign affixed to a canopy." SECTION 9. THAT a new Section 2.105(g) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: -,, -" i!.GB:lb 11Section 2.105(g) SIGN, COMMUNITY SERVICE: Any sign which solicits support for or advertises non-profit community use, public use, or social institution. Such signs may include, but shall not be limited to seasonal holidays, such as Christmas, Easter, school activities, charitable programs, or reli- gious activities.11 SECTION 10. THAT a new Section 2.105(h) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(h) SIGN, DAMAGED: Any sign which has become so de- teriorated or dilapidated as ·to require more than minimal reconditioning to restore it to an average, normal state of repcrlr.11 SECTION 11. THAT a new Section 2.105(i) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(i) SIGN, FREE STANDING: Any sign permanently affixed to the ground and which is not affixed to a build- ing and which is not used for off-premises adver- tising." SECTION 12. THAT a new Section 2.105(j) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.10S(j) SIGN, GOVERNMENTAL: Any sign indicating public works projects, public services or other programs or activities conducted or required by any govern- mental subdivision." SECTION 13. THAT a new Section 2.105(k) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(k) SIGN HEIGHT: Sign height shall be the vertical distance between the highest part of the sign or its supporting structure, whichever is higher, and the average established ground level beneath the ~i~." SECTION 14. THAT a new Section 2.105(1) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(1) SIGN, PORTABLE: Any sign not permanently affixed to the ground or to a building and which is de- signed to permit removal and reuse." SECTION 15. THAT a new Section 2.105(m) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: -5 - I LGB:lb "Section 2.105(m} SIGN, REALTY: Any sign used to advertise a real estate development site or to advertise that real estate is for sale or lease." SECTION 16. THAT a new Section 2.105(n) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(n) SIGN, ROOF: Any signs which are affixed to building roofs, excepting mansard or sloping roofs.n · SECTION 17. THAT a new Section 2.105(o) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(o) SIGN SETBACK: Sign setback shall be the horizon- tal distance between a sign and the front lot· .line, as measured from that part of the sign, including its extremities and supports, nearest to any point on an imaginary vertical plane projecting from the front lot line.11 SECTION 18. THAT a new Section 2.105(p) BE and is hereby added to Zon~ng Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(p) SIGN, SLOPING OR MANSARD ROOF: Any sign affixed to a sloping or 'rilih<t~ard roof." SECTION 19. THAT a new Section 2.105(q) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(q) SIGN, TEMPORARY ~USINESS PROMOTION: Any sign which is designed to produce revenue by advertising ser- vices, sales, or other temporary promotional pro- grams and which have a limited duration." , SECTION 20. THAT a new Section 2.105(r) BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 2.105(r) SIGN, WALL: Any ~ign affixed flat _against and parallel to a building wall. For the purposes of this definition, wall shall include window areas." SECTION 21. THAT Section 23.2-1 of Zoning Ordinance No. 7084 of the City c~ Lubbock, BE and is hereby amended to read as follows: "Section 23.2-1 All signs shall pertain to the identification of the primary uses and/or primary services provided or primary products sold on the premises, except for billboards, auxiliary ,~oy_~~~e~t:;~l ___ ~.!. .. ~~~=- _n_~!Y-s_~rvic~ sig!J.S as proviCied. n - 6 - ·~· .. THAT Section 23.2-3 of Zoning Ordinance No. 7084 of the City of Lubbock~ BE and is hereby amended to read as follows: nsection 23.2-3 Except as herein provided~ no person or business firm, acting either as principal or agent, shall alter the copy face or lettering of any sign, except for Sec. 2.14 signs and signs with temporary messages made from interchangeable characters attached to tracts or grooves on the sign board, either by changing the message or by renovating an existing message or shall erect any sign or sign structure until a sign permit for such work has been issued by the building official to a bonded contractor or the owner or occupant of the premises where the work is to be done. No permit shall be required for non-illuminated signs otherwise permitted in Sections 23.7-1, 23.7-2, 23.9-5-4, 23.10, 23.12, 23.13 or 23.14." SECTION 23. THAT Section 23.2-4 of Zoning Ordinance No. 7084 of the City of Lubbock~ BE and is hereby amended to read as follo~s: "Section 23.2-4 Not more than two sides of a sign structure may be used for display.u SECTION 24. THAT Section 23.2-5 of Zoning Ordinance No. 7084 of the City of Lubbock, BE and is hereby amended to read as follO\iiS: "Section 23.2-5 No sign, sign structure, or sign support shall project over any property line, except that a sign placed flat against the wall of a building which is on the property line may project eighteen (18) inches over the property line. ·Provided further that signs in existence on the effective date of this Ordinance which are attached to a canopy or building which projects over the property line and which has a valid street use license, shall bE permitted to remain, provided all other provisions of this ordinance are met.11 SECTION 25. THAT Section 23.2-6 of Zoning Ordinance No. 7084 of the City 1· of Lubbock BE and is hereby repealed. I SECTION 26. THAT Section 23.2-7 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby amended to read as follows: "Section 23.2-7 All business locations shall be identified by a street address sign which is clearly visible from the street.' SECTION 27. THAT Section 23.2-8 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby repealed. SECTION 28. THAT Section 23.2-9 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby amended to read as follows: -7-;. . . THAT Section 23.2-10 of Zoning Ordinance No. 7084 of the City f Lubbock, BE and is hereby amended to read as follows: "Section 23.2-10 Not more than twenty-five (25) percent of the area of !l&-~!&.~..t..~c-~£t_ -~.o!. This removal shall be done in a manner, if reasonably possible, to preserv the value of such signs and supports. If the Ad- ministrator directs an-independent contractor to remove said signs and supports, the cost of such • work shall be minimized by the Administrator to whatever extent is reasonably possible. The owners of any removed signs and supports, ex- cept signs made of paper or cardboard or their supports, shall be notified. The first attempt at notice shall be within three (3) days of the removal of the ~ign and supports. The manner of notice shall be that which will best achieve no- tice under the circumstances, including the use of certified mail, hand delivery or publication. Re- fusal of certified mail which has been properly addressed and posted shall not void the notice. Hand delivery may be employed where the addressee is within the City limits and when his whereabouts are specifically known. Publication may be used when the addressee or his whereabouts are unknown and said publication shall be done in the same manner as prescribed in Vernon's Annotated Civil Statutes for service of process by publication. Notice by publication shall be deemed sufficient regardless of its effect as actual notice. Said notice shall inform the recipient that the City of Lubbock is in possession of that certain sign and supports~ why they were removed, and where they may be reclaimed, as well as the information contained in the remainder of this section. -11.- LGB:bsb With the exception of signs made of paper or card- board and their supports which may be disposed of immediately, removed signs and supports shall be stored a period not to exceed fourteen (14) days beginning the first day of effective notice, whether actual or constructive. Before the expiration of the storage period, the owner of the sign and supports may reclaim his property upon payment of any storage charges and the cost of remov- al, if such removal was done by an independent con- tractor. THAT Section 23.9-7-2-1 of Zoning Ordinance No. 7084 of the ity of Lubbock BE and is hereby amended to read as follows: "Sec. 23.9-7-2-1 On corner lots, that frontage on the major or primary street shall be construed to be the de- velopment lot frontage, and no more than one (1) sign shall be ~e~tted, except that on a deve- lopment lot located at the intersection of two major thoroughfares or two expressways or a major thoroughfare and an expressway, a free-standing sign shall be permitted on each s~sh .~h~~~~$-~(~~~ ~r ~.P.r.~~sway or one (1) sign, of the same size, height, and setbacks, may be placed on the corner, provided it is not within the visibility triangle." SECTION 76. THAT Section 23.9-7-2-3 of Zoning Ordinance No. 7084 of the ity of Lubbock BE and is hereby amended to read as follows: "Sec. 23.9-7-2-3 To compute the allowable square footage of sign area, only one (1) side of a double face sign shall be -~O.!!,S_=!-_de_;-ed_ •. " SECTION 77. THAT Section 23.9-7-2-5 of Zoning Ordinance No. 7084 of the ity of Lubbock BE and is hereby amended to read as follows: ''Sec. 23.9-7-2-5 Free-standing signs may rotate not more than six (6) revolutions per minute." SECTION 78. THAT Section 23.9-7-2-6 of Zoning Ordinance No. 7084 of the ity of Lubbock BE and is hereby amended to read as follows: "Sec. 23.9-7-2-6 Free-standing signs may be placed on the roof of a building provided the height, setback, square footage, and location requirements of this section are met." SECTION 79. THAT Section 23.9-8 of Zoning Ordinance No. 7084 of the City f Lubbock BE and is hereby amended to read as follows: 11 Section 23.9-8 Roof Signs: Roof signs on a building which is eight (8) stories or more in height shall not be limited by Section 23.9-7-2-6 except for its al- lowable square footage requirement. THAT Section 23.10 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby amended to read as follows: "Section 23.10 Auxiliary signs not exceeding ten (10) square feetin total area per building may be placed in a window or flat against the wall of a building. Free-standing auxiliary signs of not more than two and on~alf (2~) feet in height and three (3) square feet in area are permitted on private property if limited to traffic direction or parking direction. Auxiliary sign area shall not be counted against total permitted sign area SECTION 81. That Section 23.11 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby amended to read as follows: "Section 23.11 Temporary Construction Site and For Sale and Rental Signs -For-sale signs, rental signs or temporary construction site signs not exceeding thirty-two (32) square feet in area and ten (10) feet in height may be placed at a development site, on property of one (1) acre or more for a period of one (1) year." SECTION 82. THAT Section 23.12 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby amended to read as follows: "Section 23.12 Governmental Signs -Governmental signs not exceeding thirty-two (32) square feet in area and not exceeding ten (10) feet in height, shall be permitted. Such standards shall not apply where State or Federal regulations are in conflict with these standards." SECTION 83. THAT Section ·23.13 of Zoning Ordinance No. 7084 of the City of Lubbock BE and is hereby repealed and a new Section 23.13 BE and is hereby added which shall read as follows: I "Section 23.13 Temporary Business Promotional Signs -Any temporary business promotional signs shall only be placed in or on windows and shall have a combined area not exceed- ing 10% of the area of all windows on that same wall. Said sign area shall not be counted against permitted wall sign area." SECTION 84. THAT a new Section 23.14 BE and is hereby added to Zoning Ordinance NO. 7084 of the City of Lubbock which shall read as follows: "Section 23.14 Community Service Signs-Any community servicesigns for seasonal celebration shall have no size limita- tion if placed in or on windows. Any community ser- vice signs, not of a seasonal celebration nature, shall be placed in or on windows and shall have a combined area not exceeding 10% of ·the area of all the windows on that same wall. THAT a new Section 23.15 BE and is hereby added to Zoning Or dinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15 Billboards (Poster panels or bulletins, multi-p~s~ sig~s, or painted or printed bulletins) - Outdoor advertising signs of this type shall be permitted in the "C-4", "M-1", and "M-211 Districts, subject to the following conditions." SECTION 86. THAT a new Section 23.15-1 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-1 Billboards shall be constructed to meet the construction standards as established in the City of Lubbock Building Code." SECTION 87. THAT a new Section 23.15-2 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-2 Billboards located in a "C-4" District shall be a minimum of eight (80) feet from any residenti- ally zoned property line." SECTION 88. THAT a new Section 23.15-3 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-3 The maximum area of any billboard located in a "C-4" District shall be three hundred (300) square feet." SECTION 89. THAT a new Section 23.15-4 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-4 The maximum area of any billboard located in the "U-11 , "M-2" Districts shall be seven hundred and fifty (750) square feet." SECTION 90. THAT a new Section 23.15-5 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-5 There shall be a minimum separation of two hundred (200) feet between all billboards on the same side of the street, provided however, this shall be in- creased to five hundred (500) feet on expressways." SECTION 91. THAT a new Section 23.15-6 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-6 Billboards shall have a front setback of not less than the greater of 1) 43 feet, or 2) the greatest setback of all the front buildings on the lot on L -20 - ,. ., ' .. THAT a new Section 23.15-7 BE and is hereby added to Zoning rdinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-7 Billboards shall have a maximum height of thirty- five (35) feet." SECTION 93. THAT a new Section 23.15-8 BE and is hereby added to Zoning rdinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-8 All lighting of billboards shall be so shielded as not to produce intensive or excessive light or glare on adjacent property.,, SECTION 9~ THAT a new Section 23.15-9 BE and is hereby added to Zoning Ordinance No. 7084 of the City of Lubbock which shall read as follows: "Section 23.15-9 Billboards shall be prohibited from being placed within the Canyon Lakes Policy Zone and Memorial Civic Center area." SECTION 95. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reaso the remainder of this Ordinance shall not be affected thereby. SECTION 96. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
