HomeMy WebLinkAboutOrdinance - 7375-1976 - Amending Zoning Ordinance Making Change: Case No 2106 - 12/09/1976,' LGB:bsb ORDINANCE NO. 7375 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY·OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2106; CliANGE A TRACT OF LAND OUT OF SECTION 5, BLOCK E-2, CITY OF LUBBOCK, TEXAS FROM R-1 TO A-1 ZONING DISTRICT; .AND PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommenda- tion, which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set outwil] be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in ccmpliance with Section 26 of Ordinance No. 7084 as well as notices provided by Article lOllf, Vernon1 s Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Horning Avalanche JournaO. more than fifteen (15) days prior to the date of the public hearing before tre City Council on such proposed araendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoni~ Ordinance and the Zoning Hap be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 2106 Change a tract of land out of Section 15, Block E-2, City of Lubbock, Texas, from R-1 to A-1 Zoning District. The property is further described by metes and bounds to-wit: BEGINNING at a point which bears North an approximate distance of 40.00 feet and East an approximate distance of 962.00 feet from the Southwest corner of Section 5, Block E-2; THENCE North an approximate distance of 155.00 feet; THENCE Northeasterly around a curve with an approximate chord distance of 160.00 feet; THENCE N45°E an approximate distance of 690.00 feet; THENCE S45°E an approximate distance of 460.00 feet; LGB:bsb THENCE Southerly, around a curve with an approximate chord distance of 180.00 feet; THENCE East an approximate distance of 260.00 feet; THENCE S45°W an approximate distance of 70.00 feet; THENCE Southwesterly, around a curve with an approxi- mate chord distance of 82 feet; THENCE South an approximate distance of 15.00 feet; THENCE West an approximate distance of 1110.00 feet to the Place of Beginning. SECTION 2. THAT from and after passage and effective date of this Ordinance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT should any section, paragraph, sentence, clause, phras or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
