HomeMy WebLinkAboutOrdinance - 7374-A-1976 - Correcting Ordinance 7374 By Addding Omitted Provisions Passed To Wit: Case 2104 - 08/23/1979I LGB:hw ORDINANCE NO. 7374-A AN ORDINANCE CORRECTING ORDINANCE NO. 7374 OF THE CITY OF LUBBOCK WHICH AMENDED ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK BY ADDING THERETO CERTAIN OMITTED PROVISIONS AS PASSED BY THE CITY COUNCIL AND REFLECTED IN THEIR MINUTES, TO-WIT: ZONE CASE NO. 2104; CHANGE LOTS 270 THROUGH 275, WOODLAND ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO R-2 ZONE DISTRICT AND TRACT D, WOODLAND ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO C-2 ZONE DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, Zone Case No. 2104 included the zone changes as hereinafter set- out which were duly heard by the Planning and Zoning Commission which sent its recommendation to the City Council which read the matter at two separate hearings and determined that said changes would be in the best interest of the citizens of the City of Lubbock, as reflected by the official City Council Minutes of December 9, 1976, and WHEREAS, Ordinance No. 7374 was a specific use ordinance and did not include these zone changes which would have been in a separate ordinance which cannot be found, and WHEREAS, this Ordinance will serve to replace that missing ordinance and correct the void presently existing for Zone Case No. 2104, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF LUBBOCK: ZONE CASE NO. 2104 SECTION l. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change Lots 270 through 275, Woodland Addition, City of Lubbock, Lubbock County, Texas, from R-1 to R-2 zoning district. SECTION 2. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change Tract D, Woodland Addition, City of Lubbock, Lubbock County, Texas, from R-1 to C-2 zoning district. SECTION . THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. Passed by the City Council on first reading this 23rd day of August t 1979. Passed by the City Council on second reading this 13th day of_ September , 1979.
