WHEREAS, the City Council has determined that the changes indicated beoow WDuld be in the best interest of the Citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 15 of the COde of Ordinances, City of Lubboc~ entitled "Health and Sanitatron11, BE and is hereby amended by repealing the present Article I thereof and enacting a new Article I which shall read as follows: ARTICLE I. CITY BOARD OF HEALTH Sec. 15-1. Created; official designation. There is hereby created and established a city board of health, such board to be officially designated as the City of Lubbock Board of Health. Whenever in this Article or in this code the term "Lubbock City-County Board of Health" is used it shall henceforth mean the "City of Lublt-ock Beard of Health". Sec. 15-2. Comp:>sition; appointment and terms of members. The city board of health shall be composed of seven mem- bers, each of whom shall be a resident citizen of the City of Lub'IOOck. The members of the board shall be appointed by the City Council and shall hold office for terms of three years; provided however the members <or the present Lubbock City- County ~ard of Health who are resident citizens of the City of Lubbock shall become members of the City of Lubbock Board of Health and shall hold office according to their pre- viously designated terms of office. Sec. 15-3. Ex officio members. The city manager and the director of the city health unit shall be ex officio members of the board of health1 without voting privileges. and shall act in an advisory capacity to the board. KJ:bsb Sec. 15-4. Vacancies; removal. Upon the death, resignation .. removal or expiration of the term of office of any of the members of the city board of health, the city council shall appoint a successor, who shall hold his membership on the board f>r the unexpired term of the member he is appointed to succeed, or for a period of three years, when the appointment is made due to the expiration of a board member's term. In the event the best interests of the city require the removal of any member of the board, removal of such member shall be effected through the appointment of a successciJtblj;the:umi.ni- mous vote of the city council. Sec. 15-5. Chairman; secretary; record of proceedings. The city board of health shall appoint one of its mem- bers as chairman and one of its members as secretary. It shall be the duty of t~e chairman to preside at all meet- ings of the board, and the secretary shall keep a record of all the proceedings of the board, which record shall, upon the request of the city council, be delivered to it for its inspection and review. Sec. 15-6. Meetings. The city board of health shall hold regular monthly meetings at a place and time to be determined by the board. Sec. 15-7. Recommendations; quorum. Any and all recommendations made by the board of health to the city council shall be by the concurring vote of four members of the board; provided, however, that this provision shall not exclude a minority recommenda- tion which 'is hereby authorized to be made in writing by less than a majority of the members of the board. The majority of the total membership of the board shall con- stitute a quorum for the transaction of all matters to be considered by it. KJ:bsb Sec. 15-8. Powers and duties. The city board of health shall constitute an advisory board to the city council with power to hold hearings in :the city and to consider and make recommendations to the city council in writing, from time to time, on any and all matters pertaining to the public health of the city. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
