VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has determined that it would be in the best interest of the citizens of the City of Lubbock for the supervision and operation of the Memorial Civic Center to be added to the duties of the Auditol!ium Board and that such Board and its operational department be re-named to reflect such change; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: /.~ SECTION 1. THAT Articl~ VII of Chapter 2 of the Code of Ordinan~s, City of Lubbock, BE and is hereby re-titled nCivic Center-Auditorium-Coliseum". SECTION 2. THAT Section 2-54 of Chapter 2, Code of Ordinances, City of Lubbock, BE and is hereby am~ded to read as follows: Sec. 2 ... 54. Supervision and Operation. The Civic Centers of the City of Lubbock shall be supervised and> controlled by a civic centers board to the extent as set out in this Article. In addition, the Municipal Auditorium-Coliseum shall be operated in accorq;mce with any operating agreement in effect between the City and Texas Tech University. The term "Civic Center" shall encompass the present auditorium- coliseum, the Memorial Civic Center and any future civic centers, auditoriums or coliseums. SECTION 3. THAT Section 2-56 of Chapter 2.,. Code of Ordinances, City of Lubbock, BE and is hereby amended to read as follows: Sec. 2 ... 56. Operating Fund. A special fund designated uCivic Centers Operating Fundu is hereby created and established. All money, checks, drafts and otb.er instru- ments representing or designeQ, to represent or accomplish paymel'l.t for any &nd every operation, attraction, activity and concession per- taining to the use of the civic centers or premises shall be collecte<:Q ~=~~==============================~==========================~== J. ..... - deposited and paid into such fund, under the supervision of the City finance officer, who shall provide adequate accounting and bookkeep- ing supplies, forms and procedures. Such fund shall not be used for any purpose other than the business of operating the civic centers and premises and for such maintenance, repairs, additions and equipment as may be authorized by the budget of the civic centers operational department duly approved, or supplemented by the City Council1 as provided by law. SECTION 4. THAT Section 2 .. 53 of Chapter 21 Code of Ordinances~ City of Lubbock, BE and is hereby amended to read as follows: Sec. 2-58. Created; Designation; Composition There is hereby created and established a civic centers operational board to be composed of fifteen (15) members, each of whom shall be resident citizens of the City and one of whom shall be a represent ... ative of Texas Tech University. The board shall be officially design- ated as the "Lubbock Civic Centers Board. 11 The present members of the Lubbock Auditorium-Coliseum Operational Board shall become members of the Lubbock Civic Center Board and shall hold office according to the terms of office established for the Lubbock Auditorium-Coliseum Operational Board. Whenever in this article the term "Auditorium ... Coliseum Operational Board" is used, it shall henceforth mean the 11Civic Centers Board. u SECTION 5. THAT Section 2 ... 66 of Chapter 21 Code of Ordinances, City of Lubbock, BE and is hereby amended to read as follows: Sec. 2-66. Created; Designation. There is hereby created and established a department designated uCivic Centers Operational Department. 11 Whenever in this article the term "Auditorium-Coliseum Operational Department11 is used, it shall henceforth mean the "Civic Centers Operational Department. 11 SECTION 6. THAT Section 2-67 of Chapter 2, Code of Ordinances, City of Lubbock, BE and is hereby amended to read as follows: Sec. 2 ... 6 7. Department Head Appointment The head of the civic centers department shall be a director appointed by the City Manager and shall be directly responsible to the City Man- ager or his designated staff director. The civic centers director shall 2 work with the civic centers board in carrying out the duties prescribed in this article. SECTION 7. THAT should any section# paragraph# sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative metliod provided by law. AND IT IS SO ORDERED.
