LEVYING AN OCCUPATION TAX ON COIN-OPERATED MACHINES; PROVIDING
A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that Article VI of Chapter 26 of th
Code of Ordinances of the City of Lubbock levying an occupation tax upon certain
t?oin-operated machines should be ameL1ded as indicated below: NOW THEREFOR
BE IT ORD.AliNED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 26-48. 1 of Chapter 26 of the Code of Ordinances_.
City of Lubbock,., BE and is hereby amended by adding thereto new sub-sections (a)
and (b) which shall read as follows:
{a) Forfeiture for Failure to Pay Tax.
The nowner" of a "skill or pleasure coin operated machine11 upon which the
said tax has not been paid as provided herein, shall forfeit to the City of
Lubbock the sum of not less than Ten Dollars ($10.00) nor more than Twenty
five Dollars ($25.00). Each day of failure to pay such tax shall constitute a
separate offense and incur another forfeiture, which if not paid shall be
recovered in a ciVil suit by the City in a court of competent jurisdiction in
Lubbock County_. Texas.
{b) Permit.
The Tax ... Assessor and Collector of the City of Lubbock is hereby authorized
and directed to collect_. and issue registration permits for the payment of
the tax levied herein and all departments, agencies ancb employees of the
City of Lubbock are hereby instructed to aid and assist the Tax ... Assessor an
Collector in collection of the said tax.
SECTI ON 2. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any reason1
the rcs:nainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the Ci~ Secretary is hereby authorized to cause publicati
