V; Board Of Electrical Examrs. - 12/16/2004First Reading Oecember 16, 2004 Item No. 18 ORDINANCE NO. 2004-00151 Second Reading January 13, 2005 ItemNo. 10 AN ORDINANCE REPEALING CHAPTER 2, ARTICLE XVII, SECTIONS 2-439 THROUGH 2-459; AMENDING CHAPTER 6, ARTICLE V, SECTION 6-122(1) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS BY REDEFINING ALL REFERENCES TO THE BOARD OF ELECTRICAL EXAMINERS CONTAINED IN THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS TO MEAN AND REFER TO THE BUILDING BOARD OF APPEALS; PROVIDING AN EFFECTIVE DATE, PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Legislature of the State of Texas has passed legislation redefining responsibility for regulation and licensing of persons performing electrical work in the State of Texas and has vested authority for regulation of same in the Texas Department of Licensing and Regulation through its' administrative rules, thus eliminating the necessity of the Board of Electrical Examiners as set forth in Sections 2-439 through 2-459 of the Code of Ordinances; and WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of Lubbock to eliminate the requirement, set forth in Section 6-122(1) of the Code of ordinances for inclusion of a journeyman plumber on the Board of Building Appeals and to require inclusion of a master electrician on said board; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1. THAT Sections 2-439 through 2-459 of the Code of Ordinances are hereby repealed. SECTION 2. THAT Section 6-122(1) of the Code of Ordinances is hereby amended to read as follows: Sec. 6-122. Definitions. As used in this article, the following terms shall have the meanings ascribed to them as hereinafter set forth: (1) Board: Any reference to ''The City of Lubbock Board of Electrical Examiners" or the "Board" shall mean and refer to the City of Lubbock Building Board of Appeals as established in Article II of Chapter 6 of this Code of Ordinances. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
