AN ORDINANCE ABANDONING AND CLOSING A IO-FOOT ALLEY AND
SEVEN 20-FOOT ALLEYS LOCATED IN BLOCKS 31, 32, 33, 107, 108, 111,
OVERTON ADDITION, 5TH STREET BETWEEN AVENUE R AND A VENUE T,
OVERTON ADDITION, 6TH STREET BETWEEN AVENUE R AND AVENUE T,
OVERTON ADDITION, AND AVENUE S BETWEEN THE NORTH RIGHT-OF-
WAY LINE OF 7TH STREET AND THE SOUTH RIGHT-OF-WAY LINE OF 4TH
STREET IN THE OVERTON ADDITION TO THE CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE BODY OF
THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE
OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND
CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City Council finds that the alley portions and street portions as
hereinafter described in the body of this Ordinance are no longer needed for public use
and it would be in the public interest to close, vacate and abandon the same for alley
purposes and street purposes and for public use, and it would be in the public interest to
close, vacate and abandon the same; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the alley and street portions as hereinafter described shall
BE and the same are hereby closed, vacated and abandoned for alley purposes and street
purposes and for public use, such street and alley portions being more particularly
described as follows:
I. All of 5th Street from the east right-of-way line of Avenue T to the west right-of-
way line of Avenue R between Blocks 32, 33, 1.07, and 108, Overton Addition to
the City of Lubbock, Lubbock County, Texas.
2. All of 6th Street from the east right-of-way line of Avenue T to the west right-of-
way line of A venue R between Blocks 31, 32, 108, and 111, Overton Addition.
3. All of Avenue S from the south right-of-way line of 4th Street to the north right-
of-way line of ih Street between Blocks 31, 32, 33, 107, 108, and 111 Overton
Addition.
4. All of the east-west 20-foot alley from the east right-of-way line of Avenue T to
the west right-of-way line of Avenue S in Block 31, Overton Addition.
5. All of the east-west 20-foot alley from the east right-of-way line of Avenue T to
the west right-of-way line of Avenue Sin Block 32, Overton Addition.
6. The east half of the east-west 20-foot alley from the east right-of-way line of
Avenue T to the west right-of-way line of Avenue S, east half beginning at the
east lot line of Lots 7 and 18 in Block 33, Overton Addition.
7. All of the north-south 20-foot alley from the north right-of-way line of 5th Street
northward for 256.25 feet in Block 107, Overton Addition.
8. All of the east-west 20-foot and 30-foot alley from the east right-of-way line of
the north-south alley in Block 107 Overton Addition eastward to the west right-
of-way line of A venue R.
9. All of the north-south 20-foot allel from the south right-of-way line of 5th Street
to the north right-of-way line of 6t Street in Block 108, Overton Addition.
10. All of the north-south 20-foot allel from the south right-of-way line of 6th Street
to the north right-of-way line of7 Street in Block 111, Overton Addition.
11. All of the east-west alley described as the south 10-feet of the north ½ of Lot 8 in
Block 111, Overton Addition.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.
