HomeMy WebLinkAboutOrdinance - 2004-O0101 - Amending Chpt. 6 Providing Increase In Rated Capacity Of Main Panels/Service Ent - 09/16/2004First Reading .September 16, 2004 ItemNo. 18 ORDINANCE NO. 2004-oOlOl Second Reading September 28,2004 Item No. 26 CONSIDER AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING ARTICLE V, SECTION 2-256 BY PROVIDING FOR AN INCREASE IN THE RATED CAPACITY OF MAIN PANELS FOR SERVICE ENTRANCES INSTALLED BY THE PUBLIC UTILITY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, pursuant to Section 33.001 of the Texas Utilities Code, the City of Lubbock has exclusive original jurisdiction over the rates, operations, and services of an electric utility in the municipality; and WHEREAS, Lubbock Power and Light is the City of Lubbock's municipally owned electric utility; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to provide guidelines and regulations for the rating capacity of the main panels for service entrances provided by an electric utility within the corporate limits of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK SECTION 1: THAT Section 2-256 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Section 2-256. Same-Installation by public utility. (a) For service entrances where the electrical load to be connected requires a main panel or main panels with a rated capacity of four hundred ( 400) amperes or less, or which has service entrance conductor rated four hundred ( 400) amperes or less, the load will be metered by a self- contained device and the owner or contractor will furnish the meter base or meter trough. (b) For service entrances where the electrical load to be connected requires a main panel or main panels rated over four hundred ( 400) amperes in capacity, and also requires conductors capable of carrying more than four hundred (400) amperes, the utility company will furnish all metering equipment for overhead services. The owner or contractor will be required only to bring the service entrance conductors to the rear of the building in accordance with this Code. In case of dispute the inspector shall be the arbitrating authority. SECTION 2: THAT the City Council finds and declares that sufficient written 1 notice of the date, hour, place and subject of this meeting of the Council was posted at a I I preceding this meeting, that such place of posting was readily accessible at all times to designated place convenient to the public at the City Hall for the time required by law the general public, and that all of the foregoing was done as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents of posting thereof. SECTION 3: THAT should any paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4: THAT the City Secretary is hereby authorized and directed to : cause publication of the descriptive caption of this Ordinance as an alternative method of I publication provided by law.
