HomeMy WebLinkAboutOrdinance - 2004-O0091 - Amending Chpt 16/Exceptions To Junked Vehicles - 08/26/2004[First Reading August 26,2004 ItemNo.l3 Second Reading October 28, 2004 Item No. 11 i ORDINANCE NO. 2004-oo091 AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO DEFINTIONS RELATED TO EXCEPTIONS TO JUNKED VEHICLES-LAWFULLY PARKED VEHICLES; RELOCATION OF PUBLIC NUISANCE TO ANOTHER LOCATION; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Counsel of the City ofLubbock, Texas deems it in the best interest of the health, safety, and welfare of the citizens of Lubbock to make the following amendments to Chapter 16 of the Code of Ordinances with regard to exceptions to junked vehicles-lawfully parked vehicles; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I. SECTION 1. THAT Section 16-370 of the Code of Ordinances of the City of l Lubbock, Texas, is hereby amended to read as follows: Sec. 16-370. Exceptions--Lawfully parked vehicles. This article shall not apply to: (1) A vehicle or part thereof which is completely enclosed within a building in a lawful manner where it is not visible from the street or other public or private property; (2) A vehicle or part thereof (a) that is stored or parked in a lawful manner on private property in connection with the business of a licensed vehicle dealer or a junkyard; or (b) that is an antique or special interest vehicle stored by a motor vehicle collector on the collector's property. (c) For purposes of this subsection (2), the vehicle or part thereof and the outdoor storage area, if any must be: (1) maintained in an orderly manner; (2) not a health hazard; and (3) screened from ordinary public view by appropriate means, including a fence, rapidly growing trees, or shrubbery. I SECTION 2. THAT violation of any provision of this ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock, Texas. SECTION 3. THAT should any paragraph, section, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
