HomeMy WebLinkAboutOrdinance - 2004-O0085 - Charter Amendment Election: Propose 9 Member Electric Utility Board Govern Util - 07/21/2004First Reading July 21, 2004 Item No. 21A ORDINANCE NO. 2004--{)0085 Second Reading August 16, 2004 Item No. 14 AN ORDINANCE ORDERING A CHARTER AMENDMENT ELECTION FOR SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF LUBBOCK, TEXAS, A PROPOSITION CALLING FOR ADOPTION OR REJECTION OF AN AMENDMENT TO THE CHARTER OF THE CITY OF LUBBOCK CREATING AN ELECTRIC UTILITY BOARD FOR THE GOVERNANCE, MANAGEMENT AND OPERATION OF THE CITY'S ELECTRIC UTILITY; PROVIDING FOR NOTICE OF THE ELECTION; PROVIDING SAVINGS CLAUSE; AND OTHER PROVISIONS INCIDENT AND RELATED TO THE PURPOSE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION l.THAT an election be held on the 2nd day of November, 2004, which date is the first authorized uniform election date that is more than sixty-two (62) days after final passage of this Ordinance, at which election the following propositions to adopt or reject the proposed amendments to the existing Charter of the City of Lubbock shall be submitted to the qualified voters of the City ofLubbock for adoption or rejection. PROPOSITION NO. 1 SHALL the Charter of the City of Lubbock be amended to provide that an Electric Utility Board composed of nine Lubbock citizens and eligible voters appointed by the City Council be created to govern, manage and operate the City's electric utility. FOR: AGAINST: ---------- SECTION 2. THAT in the event of approval of such proposition the following changes shall be made to the Charter of the City of Lubbock. Chapter 1, Art. XII, § 1. "The City of Lubbock's electric utility shall be governed, managed and operated by a board composed of nine members appointed by the City Council who shall be citizens and eligible voters of the City of Lubbock. Said board members shall serve terms of two (2) years, except that five members shall have initial terms of one (1) year as determined by the drawing of lots. The Board shall appoint a director of electric utilities and a general counsel for electric utilities, who shall serve at the pleasure of the Board. The director shall appoint all employees of the electric utilities except those employees serving exclusively under the general counsel's direction and authority. The Board shall determine the transfer and disbursement of all net revenues of the City's electric utility. The City Council shall retain the right to establish rates, exercise the power of eminent domain on behalf of the electric utility, issue obligations in the name of the electric utility, and approve the budget of the electric utility. Other duties and responsibilities of the board shall be as specified by the City Council in an appropriate ordinance adopted for such purpose to be effective no later than January 1 , 2005." SECTION 3. THAT an electronic voting system shall be used for this election, including early voting. Said Charter Amendment Election shall be held at the places in the City of Lubbock hereinafter designated as voting precincts and in the voting places designated in Exhibit A hereto. Voting places shall be open from 7:00a.m. to 7:00p.m., and all electors shall vote in the precinct of their residence unless such precinct shall be consolidated with another precinct as indicated in Exhibit A. The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas Election Code, shall be used for this election. SECTION 4. THAT the persons named in Exhibit A hereto are hereby appointed Judges and Alternate Judges to conduct said election on November 2, 2004. In the event any named person is unable to serve for any reason, the city secretary of the City of Lubbock is hereby authorized and directed to make such substitutions as may be required and to amend Exhibit A hereto as required. Each presiding judge so named is authorized to appoint the number of clerks authorized by the city secretary of the City of Lubbock, which number shall not be less than two (2) nor more than six (6) clerks. The alternate judges shall serve as presiding judges in the event that the regularly appointed presiding judge is unable to serve. The alternate judges shall be appointed by the presiding judge to serve as one of the clerks in the event that the regularly appoint presiding judge conducts the election. SECTION 5.THAT early voting by personal appearance shall commence on the 18th day of October, 2004, and end on the 291h day of October, 2004. Said early voting shall be conducted at the locations, days and hours indicated on Exhibit B hereto. SECTION 6. THAT the city secretary of the City of Lubbock is hereby ordered to cause publication of this Ordinance ordering the Charter Amendment Election in a newspaper of general circulation on the same day in each of two successive weeks with the first publication occurring before the 14th day before the date of the election. In addition, a copy of this Ordinance shall be posted not later than the 21st day before election day on the bulletin board used for posting notices of meetings of the governing body and a notice of consolidation shall be posted not less than 10 days before the 2 election day at any polling places not consolidated at the last previous election, which notice shall indicated the precinct of consolidation and location of the new polling place. SECTION 7. THAT the city secretary shall serve a duly certified copy of this Ordinance upon each of the presiding judges named in Exhibit A not later than the seventh day after the signing of this Ordinance, or the 15111 day before election day, whichever is later. SECTION 8. THAT this Ordinance shall become effective upon final passage by the City Council of the City of Lubbock. AND IT IS SO ORDERED.
