ORDINANCE NO. 2004-o0082
AN ORDINANCE AMENDING CHAPTER 1 OF THE CODE OF ORDINANCES OF
THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO PERMITTING PAYMENT OF
FEES, FINES, COURT COSTS AND OTHER MUNICIPAL CHARGES BY CREDIT CARD;
PROVIDING FOR A PROCESSING FEE; PROVIDING A SERVICE CHARGE; PROVIDING
A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
I WHEREAS, the City Council deems it to be in the best interest of the citizens of the City

1 ofLubbock to amend Chapter 1 ofthe Code of Ordinances to permit payment of municipal fees,
fines, court costs and other municipal charges by credit card pursuant to Chapter 132, Local

1 Government Code; NOW THEREFORE:

·.1 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended

by adding a section, to be numbered 1-12, which said section reads as follows:
l Sec. 1-12. Payments by Credit Card.
1 (a) City of Lubbock municipal officials who collect municipal fees, fines, court

costs or other charges may accept payment by credit card for such municipal fees, fines,
court costs or other charges; and
(b) a processing fee may be charged for processing payment by credit card which
shall be reasonably related to the expense incurred in processing the payment by credit
card, which shall not exceed five percent (5%) ofthe amount of the fee, fine, court cost,
or other charge being paid. The amount of such processing fee shall be set by the chief
financial officer of the City of Lubbock.
(c) a service charge may be charged if for any reason, a payment by credit card for
a fee, fine, court cost or other charge is not honored by the credit company on which the
funds are drawn. The service charge is in addition to the original fee, fine, court cost or
other charge and any processing fee and shall be in the same amount as the fee charged by
the City of Lubbock for the collection of a check drawn on an account with insufficient
funds.
(d) The municipal officer collecting such fee, or charge under this section shall
deposit the fee or charge in the general fund of the City.
SECTION 2. THAT should any paragraph, section, sentence, phrase, clause or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized and directed to cause
publication of the descriptive caption of this Ordinance as an alternative method of publication I provided by law.
