September 16, 2004 Item No. 10 v~·L 9507P~cr340 AN ORDINANCE ABANDONING AND CLOSING AN ALLEY IN THE BUSTER LONG ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND A TRANSFORMER PAD EASEMENT IN LOT 23, BUSTER LONG ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley portion and easement hereinafter described in the body of this Ordinance are no longer needed for alley and easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for alley and easement purpose and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portion and easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for alley and easement , purposes are more particularly described as follows: i TRACT ONE All of the alley situated between Lots 17 through 20 and Lots 21 through 24, Buster Long Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1305, Page 900, Deed Records of Lubbock County, Texas, said alley extending from the South right-of-way line of 51st Street to the South lot lines of said Lots 17 and 24, Buster Long Addition. TRACT TWO That Transformer Pad Easement granted to Lubbock Power and Light located at the Northeast comer of Lot 23, Buster Long Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1305, Page 900, Deed Records of Lubbock County, Texas. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, ~ showing the number ofthis Ordinance and the date of its final passage. II SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. l SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance · as an alternative method provided by law.
