HomeMy WebLinkAboutOrdinance - 2004-O0056 - Abandoning/Closing Portion Of East 2Nd Street - 05/25/2004First Reading Hay 25,. 2004 Item No. 18 File And Return fo Ed Bucy a..o .. w 25065 ORDINANCE NO. 2004-o0056 Second Reading June 9, 2004 Item No. 11 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF EAST 22Nn STREET ADJACENT TO BLOCK 4 OF WHEELOCK'S SECOND ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portion as hereinafter described in the body of this Ordinance is no longer needed for street purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for street purposes and for public use, such street portion being more particularly described as follows: The south one-half of East 22nd Street from the east line of Ash Avenue to the west line of the north-south alley between Ash and Birch A venues, further described as follows: Beginning at the northwest comer of Lot 1, Block 4, Wheelock's Second Addition to the City of Lubbock, Lubbock County, Texas; THENCE North 25 feet; THENCE East 140 feet; THENCE South 25 feet; THENCE West along the north line of said Lot 1, Block 4, a distance of 140 feet of the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number ofthis Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder ofthis Ordinance shall not be affected thereby. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
