Zone Case 2562. - 05/22/1986First Reading May 22, 1986 Agenda Item #7 Second :Reading June 12, 1986 Agenda Item #6 LJM:js ORDINANCE NO. 8921 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP Or THE CITY Or LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2562; A ZONING CHANGE FROM R-1 TO C-2A ZONING, ON LOTS 15-22, LOTS 51-56, AND TRACT E, WESTERN MEADOWS ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICA- TION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Or THE CITY Or LUBBOCK: ZONE CASE NO. 2562 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1 to C-2A under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on Lots 15 through 22, Lots 51 through 56, and Tract E, Western Meadows Addition, City of Lubbock, Lubbock County, Texas, located on the east side of Slide Road between 54th and 56th Streets and subject to conditions, and being further described as follows: METES AND BOUNDS DESCRIPTION for a 3.595 acre tract located in Western Meadows Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: -· BEGINNING at the original Southeast corner of Tract "E", Western Meadows Addition to the City of lubbock, lubbock County, Texas; THENCE West an approximate distance of 49.64 feet to a point of curvature; THENCE Southwesterly around a curve to the left, said curve having a radius of 50.00 feet and an approximate chord distance of 52.92 feet; THENCE West an approximate distance of 14.74 feet; THENCE South an approximate distance of 28.00 feet; THENCE West an approximate distance of 141.72 feet; THENCE Southwesterly around a curve to the left, said curve having a radius of 15.00 feet and an approximate chord distance of 21.21 feet; THENCE North an approximate distance of 660.00 feet to a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet and an approximate chord distance of 21.21 feet; THENCE East an approximate distance of 251.00 feet; THENCE South an approximate distance of 604.00 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONSt a. That a site plan including building elevations showing materials, color, and texture, shall be submitted and approved by the Planning and Zoning Commission on the entire tract under this zoning ordinance prior to the issuance of a building permit; and b. Subject to the conditions and development standards .of the Slide Road Development Study. SECTION 2. THAT violation of any prov1s1ons of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed the limits provided in Section 29-31(a) of the Zoning Ordinance of the City of lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - / SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
