HomeMy WebLinkAboutOrdinance - 2004-O0022 - Ordering A Bond Election To Be Held On May 15Th, 2004 - 02/19/2004ORDINANCE No. 2004-00022 First-& Final Reading Febrfrary 19~ 2004 Item No. 20 AN ORDINANCE ordering a bond election to be held in the City of Lubbock, Texas, making provision for the conduct of the election and resolving other matters incidental and related to such election. WHEREAS, the City Council of the City of Lubbock, Texas hereby finds that an election should be held to determine whether said governing body shall be authorized to issue bonds of said City in the amounts and for the purposes hereinafter identified; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1: An election shall be held on the 151h day of May, 2004 in the City of Lubbock, Texas, which date is not less than sixty-two (62) nor more than ninety (90) days from the date of the adoption hereof and is a uniform election date pursuant to V.T.C.A, Election Code, Section 41.001, for the purpose of submitting the following measures: PROPOSITION NUMBER 1 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $9,210,000 for permanent public improvements and public purposes, to wit streets improvements, including drainage, curbs, gutters, landscaping, sidewalks, curb ramps, utility line relocation and traffic signalization and the acquisition of land and rights-of-way therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 2 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $6,450,000 for permanent public improvements and public purposes, to wit: renovations and improvements to the City's civic center/auditorium facilities: such bonds to mature serially or otheiWise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otheiWise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 3 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $6,395,000 for permanent public improvements and public purposes, to wit: to acquire, improve or both, land for park purposes, such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of 45398386.1 issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 4 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $3,350,000 for permanent public improvements and public purposes, to wit: constructing, renovating, improving and equipping police/municipal court facilities, including the acquisition of land therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 5 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $2,145,000 for pemnanent public improvements and public purposes, to wit: constructing, renovating, improving and equipping library facilities; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 6 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $1,405,000 for permanent public improvements and public purposes, to wit constructing, renovating, improving and equipping fire stations; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be detenmined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 7 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $1,045,000 for permanent public improvements and public purposes, to wit: renovations and improvements to the City's animal shelter; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at 45398386.1 any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otheTWise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to p·ay the annual interest and provide a sinking fund to pay the bonds at maturity?" SECTION 2: Electronic optical scan voting equipment shall be used in the election and ballots shall be prepared in accordance with the applicable provisions of the Election Code so the voters may cast their ballots either "FOR" or "AGAINST' the aforesaid measures which shall appear on the ballot substantially as follows: PROPOSITION NUMBER 1 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $9,210,000 FOR STREET IMPROVEMENTSM PROPOSITION NUMBER 2 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $6,450,000 FOR CIVIC CENTER/AUDITORIUM RENOVATIONS AND I MPROVEMENTSn PROPOSITION NUMBER 3 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $6,395,000 FOR PARK IMPROVEMENTS" PROPOSITION NUMBER 4 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $3,350,000 FOR POLICE/MUNICIPAL COURT FACILITIES" PROPOSITION NUMBER 5 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $2,145,000 FOR LIBRARY IMPROVEMENTS" PROPOSITION NUMBER 6 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $1,405,000 FOR FIRE STATIONS" PROPOSITION NUMBER 7 "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $1,045,000 FOR ANIMAL SHELTER RENOVATIONS AND IMPROVEMENTS" The Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Lubbock County Courthouse, 904 Broadway, Lubbock, Texas, and the persons hereby appointed to serve as Manager, Tabulation Supervisor, the Presiding Judge and Alternate Presiding Judge at the Central Counting Station are as follows: 45396366.1 Rebecca Garza Kevin Evans Dorothy Kennedy Laura Perez MANAGER TABULATION SUPERVISOR PRESIDING JUDGE ALTERNATE PRESIDING JUDGE The Manager and Presiding Judge of the Central Counting Station may appoint clerks to serve at such Station, as provided by Section 127.006 of the Election Code. SECTION 3: The City shall be divided into frfty-four (54) election precincts for this election and the polling places designated for such election precincts and the persons hereby appointed to serve as Presiding Judge and Alternate Presiding Judge for each polling place are shown in Exhibit "A", which is attached hereto and incorporated herein by reference as a part hereof for all purposes. Each Presiding Judge shall appoint not less than two (2) nor more than six (6) qualified clerks to serve and assist in holding said election; provided that if the Presiding Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the clerks. On election day, the polls shall be open from 7:00A.M. to 7:00 P.M. The sealed ballot box procedure established by Subchapter C, Chapter 127, V.T.C.A., Election Code, shall be used for this election. Early voting shall be conducted at the City Secretary's office in the City Hall I 1625 13th Street, Room 206, Lubbock, Texas (Mailing Address: P.O. Box 2000, Lubbock, Texas, 79457-0001)1 in accordance with the provisions of V.T.C.A., Election Code. Early voting for this election shall begin Wednesday, April 28, 2004 and end Tuesday, May 11 I 2004, and the hours designated for early voting by personal appearance at such main early voting place shall be from 8:00A.M. to 5:00P.M. on each day, except Saturdays, Sundays and official State holidays. The Presiding Judge for the Early Ballot Board shall be Jo Taylor , who shall appoint at least two other members to serve on the Early Ballot Board for this election in accordance with Section 87.002, V.T.C.A., Election Code. Additionally, seven (7) branch offices for early voting by personal appearance shall be established at the locations identified in Exhibit B attached hereto and incorporated herein by reference as a part of this Ordinance for all purposes. Early Voting Clerks for early voting at such branch offices and the dates and hours for early voting at such offices are specified in the attached Exhibit B. SECTION 4: All resident qualified electors of the City shall be permitted to vote at said election, and on the day of the election, such electors shall vote at the polling place designated for the Election Precinct in which they reside. This election shall be held and conducted in accordance with the provisions of V.T.C.A., Election Code and Government Code, Chapter 1251, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 5: A substantial copy of this ordinance shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted at three (3) public places within the City and at the City Hall not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in a newspaper of general 45398366.1 circulation in said City, the first of said publications to appear in said newspaper not more than thirty (30) days and not less than fourteen (14) full days prior to the day of the election. Ordinance~o. 2004-D0022 CERTIFICATE OF CITY SECRETARY THE STATE 0 F TEXAS COUNTY OF LUBBOCK CITY OF LUBBOCK § § § § § I, the undersigned, City Secretary of the City of Lubbock, Texas, DO HEREBY CERTIFY as follows: 1. On the 19th day of February, 2004, a ReRUlar meeting of the City Council of the City of Lubbock, Texas was held at a meeting place within the City; the duly constituted members of the Council being as follows: MARC McDOUGAL VICTOR HERNANDEZ T. Early voting for this election shall begin Wednesday, April 28, 2004 and end Tuesday, May 11, 2004, and the hours designated for early voting by personal appearance at such main early voting place shall be from 8:00 A.M. to 5:00 P.M. on each day, except Saturdays, Sundays and official State holidays. The Presiding Judge for the Early Ballot Board shall be Jo Taylor, who shall appoint at least two other members to serve on the Early Ballot Board for this election in accordance with Section 87.002, V.T.C.A., Election Code. This election shall be held and conducted in accordance with the provisions of V.T.C.A., Election Code and Government Code, Chapter 1251, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish.
