First Reading December 8, 2003 Item No. 25 Fil* And Return To Ed Bucy R-0-W ~ 578tl ORDINANCE NO. 2003-00128 Second Reading I December 18, 200~ Item No. 30 • Vol 8938PACf 306 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF VICKSBURG A VENUE IN SECTION 16, BLOCK E-2, LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portion as hereinafter described in the body of this Ordinance is no longer needed for street purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for street purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW TIIEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for street purposes and for public use, such street portion being more particularly described as follows: METES and BOUNDS description of a 0.008 acre tract out of Section 16, Block E-2, Lubbock County, Texas, previously dedicated for street purposes and to be closed and included as part of Lot 33, Suncrest Villas, being further described as follows: BEGINNING at a found ½" rod with cap marked RPLS 4460 for the northwest comer of this tract, which bears N 89°57104" W, 1726.98 feet and South, 107.49 feet from the Northwest comer of the South half (S/2) of Section 16, Block E-2; THENCE S 89°29137" E, 27.49 feet; THENCE S 44°44149" E, 21.31 feet; THENCE South, 0.02 feet; THENCE N 89°10'4911 W, 27.63 feet; THENCE Northwesterly around a curve to the left having a radius of 15.0 feet, on a chord bearing N 44°44'49" W, a delta angle of 89°29'37", a chord distance of 21.12 feet and a tangent of 14.87 feet to the PLACE OF BEGINNING. . ., . THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. BACKGROUND/DISCUSSION: This ordinance abandons and closes a 0.008 acre street stub portion of Vicksburg Avenue at its intersection with 106th Street in the soon to be platted addition of Suncrest Villas. This addition is located south of 106th Street and west of Utica Avenue and this street stub for Vicksburg Avenue was dedicated when 106th Street was dedicated. The new plat for Suncrest Villas shifts the location of Vicksburg A venue to the east leaving a street stub portion of Vicksburg in a portion of a future platted lot. There will not be a charge for this street closure since several other street areas are being dedicated. FISCAL IMPACT: None. ITEM#/SUBJECT: # An ordinance abandoning and closing a portion of Vicksburg Avenue in Section 16, Block E-2, Lubbock County, Texas (10602 Vicksburg Avenue). Second Reading BACKGROUND/DISCUSSION: This ordinance was read for the first time at the December 8, 2003 City Council meeting as a routine consent agenda. FISCAL IMPACT: None. SUMMARY/RECOMMENDATION: The Right-of-Way Department recommends the approval of the second reading of this ordinance.
