AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2374-C; A ZONING CHANGE FROM A-1 AND A-2
TO C-4 ZONING ON A 2.2 ACRE TRACT OUT OF SECTION 4, BLOCK E,
LUBBOCK, TEXAS; SUBJECT TO CONDITIONS, PROVIDING A PENALTY,
PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council and, after due consideration, the City Council found that due
to changed conditions, it would be expedient and in the interest of the public health,
safety and general welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully compiled with, including giving notices
in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas,
and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990),
and notice was duly published in the Lubbock A valanche-Joumal more than fifteen (15)
days prior to the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice, was held in the City Council
Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in
support of the proposal; and after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinances and this Ordinance having been introduced prior to first reading hereof;
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2374-C
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning under the provisions of Section 29-29 of the Code of
Ordinances of the City of Lubbock from A-1 and A-2 to C-4 zoning district on a
2.2 acre tract out of Section 4, Block E, City of Lubbock, Lubbock County,
Texas, located east of Ave.Sand south of S. Loop 289, subject to conditions
and being further described as follows:
METES AND BOUNDS DESCRIPTION on a 2.20 Acre Tract out of Section 4,
Block E, Lubbock County, Texas prepared for zone change purposes only being
further described as follows:
BEGINNING at the Northwest comer of Tract B, Southview Park Addition to the
City of Lubbock, Lubbock County, Texas;
THENCE S 00°03'32" E, 407.63 feet to the Southwest comer of said Tract B;
THENCE N 89°53'54" W, 230.00 feet for the Southwest comer of this tract;
THENCE N 00°03'32" W, 423.37 feet to a point in the South line of Loop 289
for the Northwest comer of this tract;
THENCE around a curve to the right, having a radius of 11,444.16 feet, a chord
bearing of S 89°59'03" E, a chord distance of230.58 feet to the Place of
Beginning and containing 2.20 Acres including any Right-of-Way.
SUBJECT TO THE FOLLOWING CONDITION:
1. That the permitted uses with Loop and non-Loop frontage be restricted as follows:
a. Any use conditionally or unconditionally permitted in the "C-2A, "C-
2", or "C-3" Districts.
b. Agriculture implement and tractor sales and service (totally within a
building).
c. Ambulance service
d. Automobile and recreational vehicles sales and service (may include
body and paint shop, as accessory use).
e. Barber and beauty shop supply dealer.
f. Boat and boat trailer sales and service.
g. Builder's supply. All materials must be in a building,
h. Bus station.
1. Cafe supply dealer, fixtures.
J. Candy plant.
k. Canvas goods shop, tents and awnings. (no manufacturing)
1. Dairy supply dealer.
m. Frozen food lockers.
n. Garden Center.
o. Gasoline service station (business permitted outside of building and
outside displays of products permitted within three (3) feet of the
building).
p. Golf driving range. (Business permitted outside of building).
q. Greenhouse and plan nursery.
r. Hotel or motel.
s. Hot tamale plant.
t. Janitorial or cleaning service.
u. Job printing and lithographing.
v. Laboratory, chemical, general analysis.
w. Laundry, commercial.
x. Linen and towel supply service.
y. Magazine agency.
z. Mobile home sales.
aa. Monument sales ( outside display permitted).
bb. Motorcycle shop, including sales, rentals and services.
cc. Non-profit training centers with retail sales.
dd. Pest control service.

ee. Portable building sales (fully constructed).
ff. Print shop.
gg. Produce market
hh. Public kennel (totally within a building).
11. Rental store.
JJ. Rescue mission of the type sponsored by non-profit organizations.
kk Restaurant. (business permitted outside of building).
11. Restaurants, with the sale of alcoholic beverages as an incidental use,
except that no mixed alcoholic beverage sales shall be made or
delivered to occupants in motor vehicles.
mm. Road machinery sales and service (totally within a building).
nn. Pawn shop.
oo. Second hand or used care sales lot, not including wrecking and
repairing, but including minor tuning.
pp. Sign shops, limited to window lettering, painted wall signs, banners
and desk signs.
qq. Store fixtures sales (no manufacturing permitted).
rr. Swimming pool, commercial or sales (business permitted outside of
building).
ss. Trailer and truck sales, rental or service.
tt. Trailer and truck rental utility.
uu. Upholstery shop -furniture.
vv. Veterinary hospital (totally within a building).
ww. Wholesale house, sales office and storage no cotton storage.
xx. Electronic components assembly.
SECTION 2. THAT violation of any provision of this Ordinance shall be deemed
a misdemeanor punishable by fine not to exceed Two Thousand and No/100 Dollars
($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of
Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED.
