HomeMy WebLinkAboutOrdinance - 2003-O0031 - Emergency Ordinance Amending 1997 Ediiton Of Uniform Fire Code - 04/10/2003ORDINANCE NO. 2003-00031 First and Final Reading April 10, 2003 Item No. 35 AN EMERGENCY ORDINANCE AMENDING THE 1997 EDITION OF THE UNIFORM BUILDING CODE AND THE 1991 EDITION OF THE UNIFOR.Jv1 FIRE CODE PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODES IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; AND PROVIDING FOR PUBLICATION WHEREAS, it is the opinion of the City Council that the best interests of the citizens of the City of Lubbock would be served by amending the 1997 Edition of the Uniform Building Code and the 1991 Edition of the Uniform Fire Code with regard to meeting local conditions; and WHEREAS, THE City Council of the City of Lubbock finds that the need to protect the public health of the citizens of Lubbock creates an emergency requiring passage of this Ordinance as an emergency on one reading as provided by the Charter of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 6 of the Code of Ordinances of the City of Lubbock is hereby amended by deleting Sec. 6-35.1, (Sec. 904.2.3.1 of the 1997 Edition of the Uniform Building Code.) SECTION 2. THAT Sec. 6-35.1 of the Code of Ordinances of the City of Lubbock, (Section 904.2.3.1 of the 1997 Uniform Building Code) is hereby amended to read as follows: Sec. 6-35.1. Section 904.2.3.1. Assembly. Food and/or Drink Consumption An automatic sprinkler system shall be provided throughout the floor area of buildings and portions ·n1ereof used as Group A Occupancies intended for food and/or drink consumption and in all floors between the Group A Occupancy and the level of exit discharge including, but not limited to Banquet halls, Night clubs, Restaurants, Taverns and Bars. An automatic sprinkler system shall be provided for Assembly occupancies with food and/or drink consumption where one of the following conditions exists: 1. The fire area exceeds 5,000 square feet; 2. The fire area has an occupant load of 300 or more; or 3. The fire area is located on a floor other than the level of exit discharge. Fire area. The aggregate floor area enclosed and bounded by firewalls, fire barriers, exterior walls or fire-resistance-rated horizontal assemblies of a building. SECTION 3. THAT Sec. 11-80 of the Code of Ordinances of the City of Lubbock, (Section 10.507(c) of the 1991 Uniform Fire Code) is hereby amended to read as follows: Sec. 11-80. Section 10.507(c). Group A Occupancies. 1. Food and/or Drink Consumption. An automatic sprinkler system shall be provided throughout the floor area of buildings and portions thereof used as Group A Occupancies intended for food and/or drink consumption and in all floors between the Group A Occupancy and the level of exit discharge including, but not limited to Banquet halls, Night clubs, Restaurants, Taverns and Bars. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor with a fine not to exceed One thousand dollars ($1,000), punishable as provided by Sec. 11-72 of the Code of Ordinances of the City of Lubbock. SECTION 5. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. SECTION 7. THAT this Ordinance shaU take effect immediately. AND IT IS SO ORDERED. Passed by the City Council as an emergency on first reading this 10th day of April , 2003.
