HomeMy WebLinkAboutOrdinance - 2003-O0018 - Abandoning/Closing Portion Of 20 Ft Alley, Overton Addition And Poriton Of 5Th - 02/13/2003First Reading February 13» 2003 Item No. 50 FILE AND RtrURN TO £D BUCY a-o-w i6002 .Second Reading June 12, 2003 Item No. 58 ORDINANCE NO. 2003-00018 Vi1L 9805ucE111 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A 20 FOOT ALLEY LOCATED IN BLOCK 132, OVERTON ADDITION AND A PORTION OF 5TH STREET BETWEEN AVEJ\.'UE X AND UNIVERSITY AVENUE IN THE OVERTON ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley portion and street portion as hereinafter described in the body of this Ordinance are no longer needed for public use · and it would be in the public interest to close, vacate and abandon the same for alley purposes and street purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portion and street portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for alley purposes and street purposes and for public use, such alley and street portions being more particularly described as follows: 1. All of 5th Street which is situated between the East right-of-way line of University Avenue and the West right-of-way line of Avenue X, 2. All of that 20' wide alley situated between 5th Street and 6th Street and between the East right-of-way line of University Avenue and the West right-of-way line of Avenue X, located in Block 132, Overton Addition to the City of Lubbock. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
