AN ORDINANCE ABANDONING AND CLOSING A TEMPORARY DRAINAGE
EASEMENT LOCATED IN SECTION 36, BLOCK A-K, LUBBOCK COUNTY,
TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATON.
WHEREAS, the City Council finds that the easement portion as hereinafter
described in the body of this Ordinance is no longer needed for public use and it would
be in the public interest to close, vacate and abandon the same for easement purposes and
public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement portion as hereinafter described shall BE and
the same is hereby closed, vacated and abandoned for easement purposes and for public
use, such easement being more particularly described as follows:
A 30' TEMPORARY DRAINAGE EASEMENT located in Section 36, Block
A-K, Lubbock County, Texas and filed for record in Volume 5746, Page 346 of
the official Real Property Records of Lubbock County, whose centerline is
described as follows:
BEGINNING at a point in the present North right-of-way line of 66th Street which
bears North 89°59'00" West a distance of 3,067.57 feet and North 00°00'30" East
a distance of 40.00 feet from the Southeast comer of Section 36, Block A-K,
Lubbock County, Texas; ·
THENCE North a distance of671.1 feet to the Southeast comer of Tract 5A-2,
Lowery Subdivision;
THENCE North pass the Southeast comer of said Tract 5A-2 along the East line
of Tract 5A-2 a distance of 650.27 feet to a point;
THENCE North 60° East a distance of276.87 feet, more or less, to a point in the
South right-of-way line of Spur 327 and containing 1.128 acres ofland, more or
less.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption ofthis Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.
