HomeMy WebLinkAboutOrdinance - 2002-O0125 - Amending/Closing Poriton Of 66Th Street - 11/21/2002-First Reading November 21, 2002 Item No. 15 'fiie And R~tur::; i\~ '·tid Bu¢y R-O~W ORDINA§gt1_~· 2002-00125 Second Reading January 23, 2003 Item No. 13 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF 66TH STREET LOCATED IN SECTION 36, BLOCK AK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portion as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same for street purposes and for public use and it would be in the public interest to close, vacate and abandon the same for street purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for street purposes and for public use, such street being more particularly described as follows: METES AND BOUNDS DESCRIPTION for a 7559 sq. ft. tract of land located in Section 36, Block AK, Lubbock County, Texas, being further described as follows: BEGINNING at a 1/2" iron rod with cap found in the North right-of-way line of 66th Street which bears N. 89°59' W., 2595.00 feet and North 32.00 feet from the Southeast corner of Section 36, Block AK, Lubbock County, Texas; THENCE N. 89°59' W. a distance of 944.86 feet to a lf2" iron rod with cap found in the East line of that tract of land described in Volume 174, Page 584, Deed Records of Lubbock County, Texas: THENCE N. 00°00'34" W., along the East line of said described tract, a distance of 8.00 feet to a point in the North right-of-way line of 661h Street; THENCE S. 89°59' E., along the North right-of-way line of 66th Street, a distance of 944.86 feet to a point; THENCE South a distance of 8.00 feet to the POINT OF BEGINNING. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
