HomeMy WebLinkAboutOrdinance - 2002-O0123 - Amening Section 2-3; Discontinuing The Office Of City Secretary Treasurer - 10/24/2002First Reading October 24, 2002 Item No. 54 Second Reading November 14, 200 Item No. 40 ORDINANCE NO. 2002-o0123 AN ORDINANCE AMENDING SECTION 2-3 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO REINSTATING THE OFFICE OF CITY TREASURER; DISCONTINUING THE OFFICE OF CITY SECRETARY-TREASURER; PROVIDING THAT FINANCIAL DUTIES OF THE DISCONTINUED OFFICE SHALL BE PERFORMED BY A CITY TREASURER AND NOT THE CITY'S DIRECTOR OF FINANCE; PROVIDING THAT THE SECRETARIAL DUTIES OF THE DISCONTINUED OFFICE SHALL CONTINUE TO BE PERFORMED BY THE CITY SECRETARY; PROVIDING AN EFFECTIVE DATE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Sec. 2-3 of the Code of Ordinances of the City of Lubbock discontinued the office City Treasurer pursuant to authority granted by Chapter 1, Article IX, Section 22, Lubbock City Charter; and WHEREAS, Chapter 1, Article IX, Section 10, Lubbock City Charter provides for appointment of a City Treasurer by the Lubbock City Council; and WHEREAS, Chapter 1, Article X, Section 4, Lubbock City Charters provides for a City Secretary-Treasurer, which joint office shall be discontinued pursuant to the authority granted by Chapter 1, Section IX, Article 22, Lubbock, City Council; and WHEREAS, City Council deems it to be in the best interest ofthe citizens of the City of Lubbock to resume separate offices of City Treasurer and City Secretary as provided by the City Charter and to return the management of financial matters to a City Treasurer; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-3 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows. Sec. 2.3. Office of City Secretary-Treasurer discontinued; financial duties to be performed by City Treasurer. (a) The office of City Secretary-Treasurer be and is hereby discontinued. The financial duties of said office shall be performed by a City Treasurer appointed by the City Council rather than by a City Secretary-Treasurer or the director of finance of the City of Lubbock. (b) The City Secretary shall continue to perform the secretarial duties of said discontinued office. SECTION 2. THAT this Ordinance shall be effective following final passage by the City Council of the City Lubbock and upon appointment of a City Treasurer by the City Council of the City of Lubbock. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
