Electric Code - 10/24/2002First Reading October 24, 2002 Item No. 17 ORDINANCE NO. 2002-o0114 Second Reading November 14, 2002 Item No. 13 AN ORDINANCE AMENDING ARTICLE XVII OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE DUTIES OF THE BUILDING OFFICIAL; AMENDING ARTICLE V OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 2002 EDITION OF THE NATIONAL ELECTRICAL CODE; ESTABLISHING FEES; PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, it is the opinion of the City Council that the best interest of the citizens of the City of Lubbock would be served by establishing fees and adopting the 2002 Edition of the National Electrical Code for Lubbock with certain amendments to meet local conditions; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-441 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec.2-441.~e~bership. The board shall consist of seven (7) members. The following persons shall serve as ex officio members of the board during the terms of their respective offices, but they shall not be entitled to vote: The building official or his designated representative, the director of electric utilities or his appointee (City of Lubbock), the division superintendent of the Southwestern Public Service Company for the City of Lubbock or his appointee, and the general manager of South Plains Electrical Cooperative or his appointee. The remaining seven (7) members shall be appointed by the City Council, and they shall include: Two (2) licensed and active master electricians, one licensed and active journeyman electrician, one electrical engineer not actively engaged in the electrical contracting business, one general contractor, one residential contractor, and one layman not actively engaged in any construction business. Three (3) of the seven (7) voting members shall be initially appointed for a term of one (1) year and four (4) of the seven (7) voting members shall be initially appointed for a term of two (2) years. Thereafter, all appointments of the seven (7) voting members shall be for a term of two (2) years, however, no voting member of the board shall serve for more than two (2) consecutive terms. The chairman shall be elected by the voting members of the board annually at the regular meeting in January. SECTION 2. THAT Section 2-454 of the Code of Ordinances of the City of Lubbock, Texas, be deleted. · SECTION 3. THAT Section 6-122 the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to add a new definition number (20) and re-number . the remaining definitions, said new definition number (20) to read as follows: (20) Residential wire-man electrician: Any person licensed by the board as a residential wireman electrician or any person who has been licensed by any other city operating under the "National Electrical Code," currently adopted edition (see section 6-141), or later edition of said code and presents to the building official a certified copy of his license together with a letter from the building official of the city in which the electrician has obtained his license stating that said city has adopted and is operating under the aforementioned National Electrical Code and meets the requirements of Section 6-153 of this Code. SECTION 4. THAT Section 6-141 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-141. National Electrical Code adopted by reference. The book entitled "National Electrical Code," 2002 Edition (NFPA No. 70) a copy of which, authenticated by the signature of the building official, shall be filed with the city secretary as a public record, is hereby adopted as a part of this Code as if fully copied herein in detail. In the event of a conflict with any provision of the "National Electrical Code" and the Code of Ordinances, the Code of Ordinances shall control. References in this Code to the National Electrical Code shall mean the 2002 Edition. SECTION 5. THAT Section 6-156 of the Code of Ordinances of the City of Lubbock, Texas, be amended to add a new subsection (6), to read as follows: ( 6) Residential wireman electrician qualifying the holding to undertake electrical work on new construction of one (1) and two (2) family residences only, as an employee of and directly under the supervision of a licensed master electrician doing electrical work for the general public who will supervise his work on a daily basis. A residential wireman electrician working under the supervision of a licensed master electrician may supervise other residential wireman electricians or apprentice workers. SECTION 6. THAT Section 6-159 of the Code of Ordinances of the City of Lubbock, Texas, be amended to add a new subsection (f), to read as follows: (f) To be eligible to hold a license as a residential wireman electrician within the city, each applicant for such license shall possess the following qualifications: (1) He shall be a high school graduate or the equivalent; and 2 (2) He shall have two (2) years experience as a full-time apprentice in electrical construction under a licensed master electrician performing electrical construction work for the general public. (3) He shall demonstrate his qualifications to be licensed by passing an examination to be given by the board, with a minimum grade of seventy (70) percent. ( 4) Experience gained by an applicant prior to the applicant's sixteenth birthday shall not be counted in meeting any of the experience requirements ofthis section. SECTION 7. THAT Subsection 6-1 7 6 of the Code of Ordinances of the City of Lubbock, Texas, be amended to add a new subsection 6-176 (f)(7), to read as follows: (7) Residential wireman electrician SECTION 8. THAT Subsection 6-19l(e)(3) ofthe Code of Ordinances ofthe City of Lubbock, Texas, be amended to read as follows: (3) Homeowners permit. A homeowners electrical permit shall only be issued to a person who owns and resides in a single-family home and may be used by said homemvner to do electrical work on the premises used by the homeowner as his homestead residence. The permit issued under this subsection, Homeowner permits, shall be obtained no more than one (1) time every five (5) years. SECTION 9. THAT Section 6-226 of the Code of Ordinances of the City of Lubbock, Texas, be deleted; SECTION 10. THAT Subsection 6-227 of the Code of Ordinances of the City of Lubbock, Texas, be amended to add a new subsection (8), to read as follows: (8) Residential wireman electrician license fee ........................ $50.00 SECTION 11. THAT Subsection 6-227.1 of the Code of Ordinances of the City of Lubbock, Texas, be amended to add a new subsection (8), to read as follows: (9) Residential wireman electrician license renewal fee .............. $25.00 SECTION 12. THAT Section 6-245 of the Code of Ordinances of the City of Lubbock, Texas shall read as follows: Sec. 6-245 Arc-Fault Circuit-Interrupter Protection. Article 210.12 Arc-Fault Circuit-Interrupter Protection. Amend by deleting as follows Sub-article, (B) Dwelling Unit Bedrooms, and it entire contents. 3 SECTION 13. THAT Section 6-246 ofthe Code of Ordinances ofthe City of Lubbock, Texas shall read as follows: Sec. 6-246 Lighting Outlets Required. Article 210.70 Lighting Outlets Required. (A) Dwelling Units. (2) Additional Locations. (c). Amend to read: ( c ) Where one or more lighting outlet( s) are installed for interior stairways, there shall be a wall switch at each floor level that includes an entry way, to control the lighting outlet(s) where the stairway between floor levels has six risers or more. SECTION 14. THAT Section 6-247 ofthe Code of Ordinances ofthe City of Lubbock, Texas shall read as follows: Sec. 6-247 Underground Installations. Article 300.5 (D) Protection from Damage. Amend to read: (3) Service Conductors. Underground service conductors that are not encased in concrete and that are buried 450mm (18 in.) or more below grade shall not require their location be identified by a warning ribbon that is placed in the trench at least 300 mrn (12 in.) above the underground installation. SECTION 1 THAT Section 6-248 ofthe Code of Ordinances ofthe City of Lubbock, Texas shall read as follows: Sec. 6-248 Receptacles in Damp or Wet Locations. Article 406.8 (B) (1) 15-and 20-Ampere Outdoor Receptacles. Shall be amended to read: 15-and 20-ampere, 125-and 250-volt receptacles installed outdoors in a wet location shall not be required to have weatherproof enclosures when the attachment plug cap is inserted. SECTION 16. THAT Section 6-196 of the Code of Ordinances of the City of Lubbock, Texas shall read as foUows: Sec. 6-196 Temporary Installations. 4 Article 527.6 Ground-Fault Protection for Personnel. Shall be amended by adding to (A) and (B) to read: (A) Receptacle Outlets. A visible sign shall read: "Ground fault circuit intenupter cord set is required when using this temporary power", when a GFCI is not present on all overcurrent protection (B) Use of Other Outlets. A visible sign shall read: "Ground fault circuit interrupter cord set is required when using this temporary power", when a GFCI is not present on all overcurrent protection. SECTION 17. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock. SECTION 18. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 19. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
