AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 6 OF THE CODE
OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO
ADOPTING THE 2000 EDITION OF THE INTERNATIONAL ENERGY

. CONSERVATION CODE AND PROVIDING FOR CERTAIN AMENDMENTS TO
SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, it is the opinion of the City Council that the best interests of the
citizens of the City of Lubbock would be served by adopting the 2000 Edition of the
International Energy Conservation Code for Lubbock with certain amendments to meet
local conditions; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 6-701 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-701. International Energy Conservation Code adopted.
The 2000 Edition of the International Energy Conservation Code is a copyrighted
work o\\'ned by the International Code Council, Inc; A copy of said Energy Conservation
code is attached hereto and incorporated herein as though set out herein in detail.
References to the Energy Conservation code in this chapter shall mean the 2000 Edition
of the International Energy Conservation Code. One copy of the 2000 Energy
Conservation Code shall be filed with the City Secretary and a copy shall be maintained
in the office of the City Building Official. All such copies, with the amendments thereto,
shall be open to public inspection during the usual hours of business of the offices where
they are maintained.
SECTION 2. THAT Section 6-702 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-702. Title.
101.1 Title. Shall be amended to read:
This code shall be known as the International Energy Conservation Code of the
City of Lubbock, Texas and shall be cited as such. It is referred to herein as "this
code".
SECTION 3. THAT Section 6-703 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

Sec. 6-703. Exempt buildings.
101.4.1 Exempt buildings. Shall be amended to read:
Buildings and structures indicated in Sections 101.4.1.1 and 101.4.1.2 and
101.4.1.3 shall be exempt from the provisions of this code. Commercial buildings
provided with service water heating and/or electric lighting shall meet the
applicable provisions of Chapter 7 or 8 regardless of this exempt status.
SECTION 4. THAT Section 6-704 ofthe Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-704. Hospitals and research laboratories.
101.4.1.3 Hospitals and research laboratories. Shall be amended by adding this
subsection to read as follows:
Hospitals that are licensed by the Texas Department of Health shall be exempt
from the provisions of this code. Research laboratory buildings containing fume
hoods and other HV AC systems for the protection of occupants shall be exempt
from the provisions of this code.
SECTION 5. THAT Section 6-705 ofthe Code of Ordinances ofthe City of
Lubbock, Texas shall read as follows:
Sec. 6-705. Board of Appeals
SECTION 108 BOARD OF APPEALS. Section 108 of the 2000 International
Energy Conservation Code is hereby created and amended to read as follows:
Establishment and membership. In order to determine the suitability of
alternate materials and methods of construction and to provide for reasonable
interpretation of the provisions of this Code, there is hereby created a board of appeals,
consisting of eleven (11) members who are qualified by experience and training to pass
upon matters pertaining to building construction. The membership of the board of
appeals shall include one or more representatives from the following named areas of
expertise:

A member of the Lubbock Home Builders Association;
An active architect~
An active structural engineer;
An active commercial contractor;
An active realtor;
An active master plumber;
An active journeyman plumber;
An active mechanical contractor with a class A license; and

(9) Three (3) Lubbock citizens.
The building official shall be an ex officio member and shall act as secretary of the board.
The board of appeals shall be appointed by the governing body of the city and shall hold
office for a term of two (2) years and until their successors are qualified. The presently
constituted board members shall continue in their offices for their regular terms.
Scope. The board shall adopt reasonable rules and regulations for the conduct of
its investigations and shall render all decisions and findings in writing to the building
official with a duplicate copy to the appellant and the board may recommend new
legislation to the city council consistent with its findings.
Jurisdiction. The board of appeals shall have the authority and is vested with the
jurisdiction to hear and determine requests for substitution of alternate systems from
those provided in the 2000 International Energy Conservation Code and the 1991
I Uniform Fire Code, as adopted by the city in Article VI of Chapter 6 of the Code of
Ordinances.
Hearings. Application for hearing shall be as follows:
(1) The owner of an existing building which does not constitute a public
nuisance as declared in Section 102 of the 1997 Uniform Building Code,
but may otherwise constitute a danger to human life if permitted to be
occupied or used unless altered, changed, converted or repaired in
conformance -vvith the building code, fire code or other pertinent governing
ordinances of the city, shall in cases when compliance with such codes
presents a practical difficulty or unnecessary hardship, make written
application to the building board of appeals, on forms to be furnished by
the building official, for a recommendation as herein provided or
substitution of an alternate system to that required by the various pertinent
codes and ordinances.
(2) Each applicant shall, upon making such application, submit to the board of
appeals sufficient technical data to demonstrate that the new method or
device is equivalent in quality, strength, fire resistance, effectiveness and
safety to that prescribed by the governing code of ordinances.
Limitations of authority. The board of appeals shall have no authority relative
to interpretation of the administrative provisions of this Code nor shall the board be
empowered to waive requirements of this Code.
SECTION 6. THAT Section 6-706 of the Code of Ordinances ofthe City of
Lubbock, Texas shall read as follows:

601.2.1 Residential buildings, Type A-1. Shall be amended to read as follows:
Compliance shall be demonstrated by any one of the following:
1. Meeting the requirements of this chapter for buildings with a glazing area
that does not exceed 15 percent of the gross area of exterior walls.
2. Meeting the requirements of this chapter for buildings with a glazing
area that is greater than 15 percent but not exceeding 20 percent of
the gross area of exterior walls and air conditioning equipment rated
12 SEER or higher.
3. Meeting the requirements of this chapter for buildings with a glazing
area that is greater than 20 percent but not exceeding 25 percent of
the gross area of exterior walls and air conditioning equipment rated
13 SEER or higher.
4. Meeting the requirements of Chapter 4 or Chapter 5 for residential
buildings, Type A -1.
SECTION 19. THAT Section 6-719 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-719. Thermal performance criteria.
602.1 Thermal performance criteria. Amend 2nd paragraph to read:
Type A-1 residential buildings, with greater than 25 percent glazing area; Type
A-2 residential buildings, with greater than 25 percent glazing area; and any
residential building in climates with heating degree days (HDD) equal to or
greater than 13,000; shall determine compliance using the building envelope
requirements of Chapter 4 or Chapter 5.

Each system over 90,000 Btulh cooling capacity or 3,000 cfm located in other
than Climate Zones 1,2, or 3b as shown in Table 302.1 shall have an economizer,
when required by building specifications, that will automatically shut off the
cooling system and allow all of the supply air to be provided directly from
outdoors.

SECTION 23. THAT Section 6-723 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:

Where used to control both heating and cooling, zone thermostatic controls shall
provide a temperature range or deadband of at least 2°F within which the supply

SECTION 24. THAT Section 6-724 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:

SECTION 25. THAT violation of any provision of this Ordinance shall be
deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances
of the City of Lubbock.
SECTION 26. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 27. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
