ORDINANCE 2002-00106
AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 6 OF THE CODE
OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO
ADOPTING THE 2000 EDITION OF THE INTERNATIONAL PLUMBING CODE
AND PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER
TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, it is the opinion of the City Council that the best interests of the
citizens of the City of Lubbock would be served by adopting the 2000 Edition of the
International Plumbing Code for Lubbock with certain amendments to meet local
conditions; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 6-81 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-81. International Plumbing Code adopted.
The 2000 Edition of the International Plumbing Code published in cooperation
with: Building Officials and Code Administrators International, Inc., International
Conference of Building Officials, and Southern Building Code Congress International,
Inc. as hereinafter amended is hereby adopted as the plumbing code of the City of
Lubbock, Texas. A copy of said plumbing code is attached hereto and incorporated
herein as through set out herein in detail. References to the Plumbing Code in this
chapter shall mean the 2000 Edition of the International Plumbing Code. One copy of the
2000 International Plumbing Code shall be filed with the City Secretary and a copy shall
1 be maintained in the office of the City Building Official. All such copies, with the
· amendments thereto, shall be open to public inspection during the usual hours of business
of the offices where they are maintained.
SECTION 2. THAT Section 6-81.1 of the Code of Ordinances of the City of

Sec. 6-81.1. Title
101.1 Title. Amend to read:
These regulations shall be known as the International Plumbing Code of the City
ofLubbock, Lubbock, Texas, hereinafter referred to as "this code".
SECTION 3. THAT Section 6-81.2 ofthe Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

Administrative Authority. The administrative authority duly appointed
to enforce this Code shall be the Building Official of the City of Lubbock,
however, said building official is hereby authorized to designate qualified
employees serving under his discretion and control to assist in the
discharge of such duty. These employees shall also be referred to as "code
officials".
SECTION 4. THAT Section 6-81.3 ofthe Code of Ordinances ofthe City of
Lubbock, Texas shall read as follows:
Sec. 6-81.3. Application for permit.
106.3 Application for permit. Amend this sub-section by adding the
following paragraph at the beginning to read:
Application for permit. Permits for any type of plumbing including gas
piping, shall be issued only to a master licensed plumber, or a homeowner
doing work on a residence presently occupied as his or her homestead. All
plumbing shall be performed by state licensed plumbers except when an
exemption is granted by the State Plumbing License Law.
SECTION 5. THAT Section 6-81.4 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

to notify the administrative authority that the work is ready for inspection.
Such notification shall be called in by telephone to one of two approved
inspection lines prior to the cut-off deadline for inspections for morning
and afternoon schedules. When the inspection is placed on the schedule,
the applicant shall allow a minimum of 4 hours for the scheduled
inspection to be completed by the inspector. Should an inspector's load be
such that he cannot complete all inspection for that shift, then the
inspection will be placed as priority on the next inspection shift schedule.
Finally, should an inspection notification to the administrative authority by

the applicant pass the cut-off time, that inspection shall be placed on the
following inspection shift schedule. All inspections shall follow proper
sequential order.
SECTION 6. THAT Section 6-81.5 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

106.6.2 Fee schedule. This sub-section is amended by inserting the

The fee schedule shall be approved annually and/or periodically by the
Director of Finance for the City of Lubbock and a copy of the fee schedule
shall be inserted in this section.
SECTION 7. THAT Section 6-81.6 of the Code of Ordinances of the City
of Lubbock, Texas shall read as follows:
Sec. 6-81.6. Fee refunds.
106.6.3 Fee refunds. This sub-section is amended to read:
The code official shall authorize the refunding of fees as follows:
1. The full amount of fees shall be refunded that were erroneously
paid or collected.
2. The full amount of fees shall be refunded when paid for a permit
that has not commenced.
The code official shall not authorize the refunding of any fee paid except
upon written request by the original permittee not later than 180 days after
the date of fee payment.
SECTION 8. THAT Section 6-81.7 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

Sec. 6-81.7 Violation penalties.
108.4 Violation penalties. This sub-section is amended to read:
Any person, firm or corporation violating any provision of this Code shall
be deemed guilty of a class C misdemeanor and upon conviction thereof
shall be punishable by a fine not to exceed two hundred dollars ($200.00)
per day for each day that the violation of this Code occurs or continues
and each day shall be deemed to constitute a separate offense and upon
conviction thereof shall be punishable as herein provided. Issuance or
granting of a permit or approval of plans and specifications shall not be
deemed or construed to be a permit for, or an approval of, any violation of
any of the provisions of this Code. No permit presuming to give authority
to violate or cancel the provisions of this Code shall be valid, insofar as
the work or use, which it authorizes, is lawful.
The issuance or granting of a permit or approval of plans shall not prevent
the administrative authority from thereafter requiring the correction of
errors in said plans and specifications or from preventing construction
operations being carried on hereunder when in violation of this Code or of
any other ordinance or from revoking any certificate of approval when
issued in error.
SECTION 9. THAT Section 6-81.8 ofthe Code of Ordinances ofthe City
of Lubbock, Texas shall read as follows:
Sec. 6-81.8. Means of appeal.
109. Means of appeal. This entire section is amended to read:
1. Plumbing and mechanical board. The Building Board of Appeals shall
serve as the plumbing board of the City of Lubbock and shall perform
the duties set out herein or as may be hereafter specified by the City.
2. It shall be within the power and duty of this board to examine new
developments and changing conditions for additions, deletions,
amendments and changes to the plumbing code from time to time as it
may deem proper, and to submit to the City Council its written
suggestions for the improvement of the plumbing code of the City.
3. Appeals to the board may be made by the City Building Official or any
interested person and it is hereby made the power and duty of the
board when disputes arise between any person, firm, association,
partnership or corporation as to the meaning of the plumbing code to
interpret same, and when a majority of said board has interpreted the
plumbing code as to its meaning, said interpretation by the board shall
be final and binding on all persons, firms, associations, partnerships
and corporations.

4. In cases where the International Plumbing Code gives discretionary
power to the building official to permit deviation from the provisions
of said code, only those deviations or changes approved by the
building official involving required material substitutions must also be
approved by the board before the same can be performed in the City of
Lubbock.
SECTION 10. THAT Section 6-81.9 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-81.9. Certificate of insurance; bond.
110. Certificate of insurance; bond. A new section 110 is hereby added
to the International Plumbing Code, which shall read as follows:
Any person, firm, corporation or association seeking to acquire any permit
required under this chapter shall have in force the following insurance:
1. One hundred thousand dollars ($100,000.00) of comprehensive
general liability insurance, per occurrence, including coverage for
bodily injury and property damage with products liability and
completed operations coverage; and
2. Workman's compensation coverage as required by state law.
3. A compliance surety bond in the amount of ten thousand dollars
($1 0,000.00) may be substituted for the above insurance.
Prior to issuance of any permit, such applicant shall furnish the building
official with a certificate of insurance evidencing the required insurance
coverage or with a valid bond in the amount stated above, if applicable.
These requirements shall not apply to a homeowner seeking a permit to
work on his own residence.
The insurance coverage shall include a provision that in the event such
insurance coverage or bond is canceled or reduced, the insurance carrier or
bond surety shall notify the building official at least ten (1 0) days prior to
such cancellation or reduction in coverage. An applicant's permit shall be
automatically suspended during any period in which the applicant fails to
maintain in effect the required insurance coverage or bond.
SECTION 11. THAT Section 6-82 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

SECTION 12. THAT Section 6-83 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:

Sec. 6-83. Pipes through or under footings or foundation walls.
305.5 Pipes through or under footings or foundation walls.
Any pipe that passes through a foundation wall shall be provided with a
pipe sleeve two pipe sizes or greater than the pipe passing through the
wall.
SECTION 13. THAT Section 6-83.1 ofthe Code of Ordinances ofthe City of
Lubbock, Texas, shall read as follows:
Sec. 6-83.1. Over-excavation.
306.2.1 Over-excavation.
Where trenches are excavated below the installation level of the pipe such
that the bottom of the trench does not form the bed for the pipe, the trench
shall be backfilled to the installation level of the bottom of the pipe placed
in layers of 6 inches (152 mm) maximum depth and such backfill shall be
compacted after each placement.
SECTION 14. THAT Section 6-83.2 ofthe Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-83.2 Drainage and vent water test.
312.2 Drainage and vent water test. Amend to read:
A water test shall be applied to the drainage system either in its entirety or
in sections. If applied to the entire system, all openings in the piping shall
be tightly closed, except the highest opening, and the system shall be filled
with water to point of overflow. If the system is tested in sections, each
opening shall be tightly plugged except the highest openings of the section
under test, and each section shall be filled with water, but no section shall
be tested with less than a 5-foot head of water above floor height. In
testing successive sections, at least the upper 10 feet of the next preceding
section shall be tested so that no joint or pipe in the building, except the
uppermost 10 feet of the system, shall have been submitted to a test of less
than a 5-foot head of water above floor height. The water shall be kept
in the system, or in the portion under test, for at least 15 minutes before
inspection starts. The system shall then be tight at all points.
SECTION 15. THAT Section 6-83.3 ofthe Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-83.3. Gravity sewer test.

312.6 Gravity sewer test. Amend to read:
Gravity sewer tests shall consist of plugging the end of the building sewer
at the point of connection with the public sewer, filling the building sewer
with water, testing with not less than a 5-foot head of water and
maintaining such pressure for 15 minutes.
SECTION 16. THAT Section 6-83.4 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-83.4. Auxiliary and secondary drain systems.
314.2.3 Auxiliary and secondary drain systems. Amend by adding item
number 4.
4. Substitute a condensate high-level cutoff switch in lieu of a drain pan.
SECTION 17. THAT Section 6-84 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-84. Sheet lead.
402.4 Sheet lead. Amend to read:
Sheet lead for pans shall not weigh less than 2 Y2 pounds per square foot
coated with an asphalt paint or other approved coating.
SECTION 18. THAT Section 6-84.1 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-84.1 Sheet lead.
417.5.2.3 Sheet lead. Amend to read:
Sheet lead shall not weigh less than 2 Y2 pounds per square foot coated
with an asphalt paint or other approved coating. The lead sheet shall be
insulated from conducting substances other than the connecting drain by
15-pound asphalt felt or its equivalent. Sheet lead shall be joined by
burning.
SECTION 19. THAT Section 6-85 ofthe Code of Ordinances ofthe City of
Lubbock, Texas, shall read as follows:
Sec. 6-85. Discharge.
504.6.1 Discharge. Amend to read:

The relief valve shall discharge full size to a safe place of disposal such as
the flow, outside the building, or an indirect waste receptor. The
discharge pipe shall not have any trapped sections and shall have a visible
air gap or air break fitting located in the same room as the water heater.
The discharge shall be installed in a manner that does not cause personal
injury to occupants in the immediate area or structural damage to the
building.
SECTION 20. THAT Section 6-86 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-86. Water hammer.
604.9 Water hammer. Amend to read:
The flow velocity of the water distribution system shall be controlled to
reduce the possibility of water hammer. An air chamber or a water-
hammer arrestor shall be installed where quick-closing valves are utilized,
unless otherwise approved. Water-hammer arrestors shall be installed in
accordance with the manufacturer's specifications. Water-hammer
arrestors shall conform to ASSE 1010.
SECTION 21. THAT Section 6-86.1 of the Code of Ordinances of the
City of Lubbock, Texas, shall read as follows:
Sec. 6-86.1. Water service pipe.
605.4 Water service pipe.
Water service pipe shall conform to NSF61 and shall conform to one of
the standards listed in Table 605.4. All water service pipe or tubing,
installed underground and outside of the structure, shall have a minimum
working pressure rating of 160 psi at 73.4 degrees F. Where the water
pressure exceeds 160 psi, piping material shall have a minimum rated
working pressure equal to the highest available pressure. Plastic water
service piping shall terminate not less than 2 feet outside the point of entry
into a building. All ductile iron water pipe shall be cement mortar lined in
accordance with AWWA Cl04.
SECTION 22. THAT Section 6-86.2 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-86.2. Solvent cementing.
605.21.2 Solvent cementing. Amend to read:

Joint surfaces shall be clean and free from moisture. A purple primer that
conforms to ASTM F 656 shall be applied. Clear primer in lieu of purple
is acceptable where joints are accessible. Solvent cement not purple in
color and conforming to ASTM D 2564 or CSA CAN/CSA-B137.3 shall
be applied to all joint surfaces. The joint shall be made while the cement
is wet and shall be in accordance with ASTM D 2855. Solvent-cement
joints shall be permitted above or below ground.
SECTION 23. THAT Section 6-86.3 of the Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-86.3. Location of full-open valves.
606.1 Location of full-open valves. Full open valves shall be installed in
the following locations;
1. On the building water service pipe from the public water supply.
2. On the water distribution supply pipe at the entrance into the structure if the
water meter is more than 1 00 feet from the building.
3. On the water supply pipe to a gravity or pressurized water tank.
4. On the water supply pipe to every water heater.
SECTION 24. THAT Section 6-86.4 of the Code of Ordinances of the City of
Lubbock, Texas shall read as follows:
Sec. 6-86.4. Location of shut off valves.
606.2 Location of shut off valves. Shutoff valves shall be installed in the
following locations:
1. On the fixture supply to each plumbing fixture in other than one-and two-family
and multiple-family residential occupancies, and other than in individual
guestrooms that are provided with unit shutoff valves in hotels, motels, boarding
houses and similar occupancies.
2. On the water supply pipe to each appliance or mechanical equipment.
SECTION 25. THAT Section 6-86.5 ofthe Code of Ordinances of the City of
Lubbock, Texas, shall read as follows:
Sec. 6-86.5. Water-tight casings.
608.17.4 Water-tight casings. Amend sub-section to read:
Each well shall be provided with a water-tight casing to minimum distance
of 10 feet below the ground surface. All casings shall extend at least 12
inches above the well platform. The casing shall be large enough to
permit installation of a separate drop pipe. Casings shall be sealed at the

bottom in an impermeable stratum or extend several feet into the water-
bearing stratum.
SECTION 26. THAT Section 6-87 of the Code of Ordinances of the City of

The only vertical pipe of a combination drain and vent system shall be a
45 degree or less at main take-off and the connection between the fixture

SECTION 41. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 42. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
