HomeMy WebLinkAboutOrdinance - 2002-O0113 - Amending Article VI Chapter 6 Adding Chapter 11 Of The 200 Edition - 10/24/2002First Reading October 24, 2002 Item No. 16 ORDINANCE 2002-o0113 Second Reading November 14, 2(1)2 Item No. 12 AN ORDINANCE AMENDING ARTICLE VI OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING CHAPTER 11 OF THE 2000 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE WITH REGARDS TO THE ENERGY EFFICIENCY AND ESTABLISHING A BOARD OF APPEALS AND PROVIDING FOR CERTAIN AMENDMENTS IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. THIS ORDINANCE SHALL TAKE PRECEDENT OVER ALL OTHER PORTIONS OF CHAPTER 6 IN REGARD TO ONE AND TWO FAMILY DWELLINGS EXCEPT FOR THE ADMINISTRATIVE PROVISIONS. WHEREAS, it is the opinion of the City Council that the best interest of the citizens of the City of Lubbock would be served by adopting the 2000 Edition of the International Residential Code, 5th Printing, for Lubbock with certain amendments to meet local conditions; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 6-344 of the Code of Ordinances of the City of Lubbock, Texas shall read as follows: Sec-344. ENERGY EFFICIENCY Chapter 11, ENERGY EFFICIENCY, of the 2000 International Residential Code shall be adopted with the following amendments. SECTION 2. THAT Section 6-344.1 of the Code of Ordinances of the City of Lubbock, Texas shall read as follows: Sec. 6-344.1 Residential buildings, Type A-1. N1101.2.1 Residential buildings, Type A-1. Amend to read: Compliance shall be demonstrated by any one of the following: 1. Meeting the requirements of this chapter for buildings with a glazing area that does not exceed 15 percent of the gross area of exterior walls. 2. Meeting the requirements of this chapter for buildings with a glazing area that is greater than 15 percent but not exceeding 20 percent of the gross area of exterior walls and air conditioning equipment rated 12 SEER or higher. 3. Meeting the requirements of this chapter for buildings with a glazing area that is greater than 20 percent but not exceeding 25 percent of the gross area of exterior walls and air conditioning equipment rated 13 SEER or higher. 4. Meeting the requirements of the International Energy Conservation Code for residential buildings, Type A-1. SECTION 3. THAT Section 6-344.2 ofthe Code of Ordinances ofthe City of Lubbock, Texas shall read as follows: Sec. 6-344.2 Thermal performance criteria. Nl102.1 Thermal performance criteria. Amend to read: The minimum required insulation R-value or maximum required U-factor for each element in the building thermal envelope (fenestration, roof/ceiling, opaque wall, floor, slab edge, crawl space wall and basement wall) shall be in accordance with the criteria in Table Nll02.1. Residential buildings, Type A-1, with greater than 25-percent glazing area; residential buildings, Type A-2, with greater than 25-percent glazing area; and any residential building in climates with HDD equal to or greater than 13,000; shall determine compliance using the building envelope requirements of the International Energy Conservation Code. SECTION 4. THAT Section 6-344.4 ofthe Code of Ordinances ofthe City of Lubbock, Texas shall read as follows: Sec. 6-344.4 Maximum solar heat gain coefficient for fenestration products. Nll02.2 Maximum solar heat gain coefficient for fenestration products. Shall be amended to read: The area-weighted-average solar heat gain coefficient (SHGC) for glazed fenestration installed in climate zone with less than 3500 HDD shall not exceed 0.40. SECTION 6. THAT Section 6-344.5 of the Code of Ordinances of the City of Lubbock, Texas shall read as follows: Sec. 6-344.5 Duct insulation. N1103.3 Duct insulation. Shall be amended to read: All portions of the air distribution system shall be installed in accordance with Section M1601 and be insulated to an installed R-5 when system components are located within the building but outside of conditioned space, and R-6 when located outside of the building. When located within a building envelope assembly, at least R-6 shall be applied between the duct and that portion of the assembly furthest from conditioned space. SECTION 7. THAT Section 6-400.1 ofthe Code of Ordinances of the City of Lubbock, Texas shall read as follows: Sec. R112 BOARD OF APPEALS Section Rll2 of the 2000 International Residential Code 1s hereby amended to read as follows: Establishment and membership. In order to determine the suitability of alternate materials and methods of construction and to provide for reasonable interpretation of the provisions of this Code, there is hereby created a board of appeals, 1 consisting of eleven (11) members who are qualified by experience and training to pass upon matters pertaining to building construction. The membership of the board of appeals shall include one or more representatives from the following named areas of expertise: (1) (2) (3) (4) (5) (6) (7) (8) (9) A member of the Lubbock Home Builders Association; An active architect; An active structural engineer; An active commercial contractor; An active realtor; An active master plumber; An active journeyman plumber; An active mechanical contractor with a class A license; and Three (3) Lubbock citizens. The building official shall be an ex officio member and shall act as secretary of the board. The board of appeals shall be appointed by the governing body of the city and shall hold office for a term of two (2) years and until their successors are qualified. The presently constituted board members shall continue in their offices for their regular terms. Scope. The board shall adopt reasonable rules and regulations for the conduct its investigations and shall render all decisions and findings in writing to the building official with a duplicate copy to the appellant and the board may recommend new legislation to the city council consistent with its findings. Jurisdiction. The board of appeals shall have the authority and is vested with the jurisdiction to hear and determine requests for substitution of alternate systems from those provided in the 2000 International Residential Code and the 1991 Uniform Fire Code, as adopted by the city in Article VI of Chapter 6 of the Code of Ordinances. Hearings. Application for hearing shall be as follows: (1) The owner of an existing building which does not constitute a public nuisance as declared in Section 102 of the 1997 Uniform Building Code, but may otherwise constitute a danger to human life if permitted to be occupied or used unless altered, changed, converted or repaired in conformance with the building code, fire code or other pertinent governing ordinances of the city, shall in cases when compliance with such codes presents a practical difficulty or unnecessary hardship, make written application to the building board of appeals, on forms to be furnished by the building official, for a recommendation as herein provided or substitution of an alternate system to that required by the various pertinent codes and ordinances. (2) Each applicant shall, upon making such application, submit to the board of appeals sufficient technical date to demonstrate that the new method or device is equivalent in quality, strength, fire resistance, effectiveness and safety to that prescribed by the governing code or ordinances. Limitations of authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this Code nor shall the board be empowered to waive requirements of this Code. SECTION 8. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock. SECTION 9. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 10. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
