ORDINANCE NO. 2002-o0061
AN ORDINANCE AMENDING SECTION 1-10 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, TO PROVIDE FOR REVIEW
AND ADJUSTMENT OF PERMIT, LICENSE AND FEE AMOUNTS ON A SEMI-
ANNUAL BASIS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City Council of the City of Lubbock deems it to be in the best
interest of the citizens of the City of Lubbock to provide for review and adjustment of
City permit, license and fee amounts on a semi-annual basis; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Section 1-10 of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
Section 1-10. Permit, license and fee amounts to be adjusted semi-annually.
(a) The permit, license and fee amounts provided for in this Code or
otherwise charged by the City of Lubbock shall hereafter be reviewed and
adjusted semi-annually concurrently with the preparation of the City budget and
revised budget each year. The base amount for such permits, licenses and fees
shall be the amount in effect upon final passage of this ordinance.
(b) Prior to adoption of a budget each fiscal year and prior to adoption
of a revised budget at each mid-year, the person serving as the City's finance
director or equivalent shall review the permit, license and fee amounts provided
by this Code and such other fees as may be charged by the City of Lubbock and
shall recommend adjustment of such fee amounts as shall need revision in the
opinion of the City's finance director.
(c) A list of permit, license and fee amounts recommended to be
adjusted shall be included in the proposed budget or revised budget, as applicable,
for review and adoption by the City Council of the City of Lubbock.
SECTION 2. THAT should any paragraph, section, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized and directed to cause
publication of the descriptive caption of this Ordinance as an alternative method of
publication as provided by law.
