AN ORDINANCE ABANDONING AND CLOSING A PORTION OF 98TH
STREET LOCATED IN SECTION 14, BLOCK E-2, LUBBOCK COUNTY, TEXAS,
AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the street portion as hereinafter
described in the body of this Ordinance is no longer needed for public use and it would
be in the public interest to close, vacate and abandon the same for street purposes and
for public use and it would be in the public interest to close, vacate and abandon the
same for street purposes and public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the street portion as hereinafter described shall BE and the
same is hereby closed, vacated and abandoned for easement purposes and for public
use, such being more particularly described as follows:
METES AND BOUNDS DESCRIPTION of a 0.137 acre tract located in
Section 14, Block E-2, Lubbock County, Texas, being further described as
follows:
BEGINNING at a railroad spike set in the East right-of-way line of Orlando
Avenue and in the South line of Section 14, Block E-2, said spike bears N.
89°59'05" E. a distance of 1,172.93 feet from the Southwest corner of Section
14, Block E-2, Lubbock County, Texas;
THENCE N. 00°01' 10" E., along the East right-of-way line of Orlando
Avenue, a distance of 70.00 feet to a Y2''rod set with cap;
THENCE Southeasterly around a curve to the left, said curve having a radius of
15.00 feet, a central angle of 90°02'0511 , tangent lengths of 15.01 feet and a
chord distance of 21.22 feet to a 112" rod set with cap;
THENCE N. 89°59'05" E. a distance of92.99 feet to a 112" rod set with cap;
THENCE s. 00°01 I 10" w. a distance of 54.99 feet to a railroad spike set in the
South line of Section 14, Block E-2;
THENCE S. 89°59'05" W., along said South line of Section 14, Block E-2, a
distance of 108.00 feet to the POINT OF BEGINNING.
SECTION 2. THAT the City Engineer is hereby authorized and directed to
mark the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.
