HomeMy WebLinkAboutOrdinance - 2002-O0042 - Amending Chapter 8 Of Code; Section 8-4(B) With Regard To Voting Precincts - 04/11/2002First Reading Apri1 11, 2002 Item No. 22 Second Reading Apri1 25, 2002 Item No. 21 ORDINANCE NO. 2002-o0042 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTION 8-4(b) WITH REGARD TO CONFORMING THE LIST OF VOTING PRECINCTS CONTAINED IN THE VARIOUS CITY COUNCIL DISTRICTS TO ORDINANCE NO. 2002-00009 ENACTED JANUARY 23, 2002; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City CoWlcil of the City of Lubbock heretofore on January 23,2002, enacted ordinance No. 2002-00009 as required by Sec. 42.06, Texas Election Code to conform the city's voting precincts to the changes to voting precincts made by Lubbock CoWlty in response to the Order of the U.S. District Court in Balderas v. State of Texas, No. 6:01CV158 (E.D. Tex.); and WHEREAS, the City CoWlcil deems it to be in the best interest of the citizens of the City of Lubbock to conform the list of voting precincts contain in Council District No.5 to include new voting precincts No. 115 and 116; and WHEREAS, conformance of said list to the official map of voting precincts adopted by Ordinance No. 2002-00009 will not be a change to any voting procedures or practices for the City of Lubbock requiring submission to the U.S. Department of Justice; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT subsection 8-4(b) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to the following named City Council voting district: CoWlcil District No.5: Precinct Nos. 7, 27, 55, 57, 62, 66, 73, 78, 96, 104,110, 111, 112, 115 and 116. SECTION 2. THAT all portions of Chapter 8 of the Code of Ordinances not amended by this Ordinance shall remain the same. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared Wlconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety in both English and Spanish languages following final passage by the City CoWlcil. SECTION 5. THAT this Ordinance shall effective upon final passage. AND IT IS SO ORDERED.
