ORDINANCE NO. 2002...00020
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2931; A ZONING CHANGE FROM R-1 TO A-2
ZONING LIMITED TO CHURCH AND CHURCH RELATED USES ON AN
UNPLATTED 5.147-ACRE AND 9.716-ACRE TRACTS OF LAND OUT OF
SECTION 1, BLOCK JS, LUBBOCK, TEXAS; PROVIDING A PENALTY;
SUBJECT TO CONDITIONS, PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council and, after due consideration, the City Council found that due
to changed conditions, it would be expedient and in the interest of the public health,
safety and general welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully compiled with, including giving notices
in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas,
and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990),
and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15)
days prior to the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice, was held in the City Council
Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in
support of the proposal; and after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinances and this Ordinance having been introduced prior to first reading hereof;
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2931
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning under the provtslons of Section 29-29 of the Code of
Ordinances of the City of Lubbock from R-1 to A-2 zoning district limited to
church and church related uses on an unplatted 5.147-acre and 9.716-acre
tracts of land out of Section 1, Block JS, City of Lubbock, Lubbock County,
Texas, located north of Auburn Street and east of Dover Avenue. Subject to
the following condition and being further described as follows:
Tract A
METES AND BOUNDS DESCRIPTION of a 9.716 acre tract ofland located
in Section 1, Block J-S, Lubbock County, Texas, being further described as
follows:
BEGINNING at a~" iron rod with cap found in the North right-of-way line
of Auburn Street at the Southeast corner of a 43.09 acre tract recorded in
Volume 783, Page 147, Deed Records of Lubbock County, Texas and the
Southwest corner of this tract which bears S. 89°58' 13" E. a distance of
2133.06 feet and S. 00°12'22" W. a distance of 2618.42 feet from the
Northwest corner of Section 1, Block J-S, Lubbock County, Texas;
THENCE N. 00°12'22" \V., along the East line of said 43.09 acre tract, a
distance of 856.96 feet to a railroad spike found at the intersection of the
South right-of-way line of Colgate Street and the East right-of-way line of N.
Dover Avenue, same being the Northeast corner of said 43.09 acre tract and
the Northwest corner of this tract;
THENCE S. 89°55'52" E. a distance of 495.75 feet to a~" iron rod with cap
set for the Northeast corner of this tract;
THENCE S. 00°01'47" W., at 295.66 feet pass a~" iron rod with cap found
at the Northwest corner of a 10.332 acre tract recorded in Volume 6876, Page
60, Real Property Records of Lubbock County, Texas, continuing along the
West line of said 10.332 acre tract for a total distance of 856.61 feet to a ~"
iron rod with cap found in the North right-of-way line of Auburn Street at
the Southeast t~orner of this tract;
THENCE N. 89°58'13" W, along said North right-of-way line, a distance of
492.22 feet to the Point of Beginning.
Tract B
METES AND BOUNDS DESCRIPTION of a 5.147 acre tract of land located
in Section 1, Block J-S, Lubbock County, Texas, being further described as
follows:
BEGINNING at a~" iron rod with cap found at the Northwest corner of a
10.332 acre tract recorded in Volume 6876, Page 60, Real Property Records
of Lubbock County, Texas and the Southwest corner of this tract which
bears S. 89°55'52" E. a distance of 2636.06 feet and S. 00°01'48" W. a
distance of 2055.64 feet from the Northwest corner of Section 1, Block J-S,
Lubbock County, Texas;

THENCE N. 00°01'47" E. a distance of295.66 feet to a Yz" iron rod with cap
set for the Northwest corner of this tract;
THENCE S. 89°55'52" E. a distance of 759.00 feet to a Yz" iron rod with cap
set for the Northeast corner of this tract;
THENCE S. 00°01'47" W. a distance of 295.14 feet to a Yz" iron rod with cap
found at the Northeast corner of said 10.332 acre tract and the Southeast
corner of this tract;
THENCE N. 89°58'13" W., along the North line of said 10.332 acre tract, a
distance of 759.00 feet to the Point of Beginning.
SUBJECT TO THE FOLLOWING CONDITION:
1. A-2 limited to church and church related uses.
SECTION 2. THAT violation of any provision ofthis Ordinance shall be deemed
a misdemeanor punishable by fine not to exceed Two Thousand and Noll 00 Dollars
($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of
Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
ofthe descriptive caption of this Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED.
