HomeMy WebLinkAboutOrdinance - 2002-O0010 - Abandoning/Closing A Potion Of A 20 Foot Alley In Block 28, Rushland Park - 02/14/2002First Reading February 14, 2002 Item No. 16 2806~( file And Raturn !o Ed Su,y R-0-W ORDINANCE NO. 2002-oOOIO VOl 775flPACE13 5 Second Reading May 9, 2002 ' Item No. 10 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A 20 FOOT ALLEY LOCATED IN BLOCK 28, RUSHLAND PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council fmds that the alley portion as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and 2.bandon the same for alley purposes and for public use and it would be in the public interest to close, vacate and abandon the same for alley purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portion as hereinafter described shall BE and the same is hereby closed, vacated and abaudoned ·;'-':· alley purposes and for public use, such alley being more particularly described as follows: METES AND BOUNDS DESCRIPTION of a portion of a 20 foot alley to be closed located in Block 28, Rushland Park Addition, being further described as follows: BEGINNING at a cross found cut on concrete at the Northeast corner of Lot 1, Block 28, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1484, Page 497, Deed Rxords of Lubbock County, Texas, same being in the West line of Lot 18, Block 34, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1422, Page 253, Deed Records of Lubbock County, Texas for the Southeast corner of this tract; THENCE N. 79°24.35" W., along the North line of said Lot 1, Block 28, Rushland Park Addition, at 141.79 feet pass a point at the Northwest corner of said Lot 1, Block 28, Rushland Purk Addition, same being the Northeast corner of Lot 2, Block 28, Rushland ParK Addition, continuing along the North line of said Lot 2, Block 28, Rushland Pafk Addition, for a total distance of 194.78 feet to a Y2 square tube found for the most Southerly Southwest corner of this tract; THENCE N. 35°18'35" W., along the North line of said Lot 2, Block 28, Rushland Park Addition, a distance of 30.35 feet to a lf2 iron rod with cap set for the most Westerly Southwest corner of this tract; THENCE North a distance of 34.60 feet to a % iron rod with cap set in the West line of Tract "L", Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1888, Page 310, Deed Records of Lubbock County, Texas, for the Northwest corner of this tract; THENCE S. 35°18'35" E., along the West line of said Tract "V,, Rushland Park Addition, a distance of 50.48 feet to a% iron rod found in the South line of said Tract "L", Rushland Park Addition; THENCE S. 79°24'35" E., along the South line of said Tract "L", Rushland Park Addition, a distance of 182.94 feet to a cross found cut on concrete at the Southeast corner of said Tract "L", Rushland Park Addition, same being the Southwest corner of Tract "A,,, Rushland Park Addition and the Northwest corner of Lot 18, Block 34, Rushland Park Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1422, Page 253, Deed Records of Lubbock County, Texas, for the Northeast comer of this tract; THENCE South, along the West line of said Lot 18, Block 34, Rushland Park Addition, a distance of 20.35 feet to the Point of Beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. ITEM#/SUBJECT: CITY OF LUBBOCK AGENDA ITEM SUMMARY # Consider an ordinance abandoning and closing a portion of a 20-foot alley located in Block 28, Rushland Park Addition {4602 7th Street). BACKGROUND/DISCUSSION: This ordinance abandons and closes a portion of a 20-foot alley north of 7th Street and just west of Salem Avenue in the Rushland Park Addition. The requestor of this closure Is Dr. Jim Harrell and the alley is being closed for replat purposes. Total area being closed is 4,585-sq. ft. and a new north-south alley will be dedicated to replace this alley being closed. The old alley will remain as an underground utility easement to satisfy existing utilities. RECOMMENDATION: The Right-of-Way Department recommends the approval of the first reading of this ordinance. BACKGROUND/DISCUSSION: This ordinance was read for the first time at the February 14, 2002 City Council meeting as a routine consent agenda item. SUMMARY/RECOMMENDATION: The Right-of-Way Department recommends the approval of the second reading of this ordinance.
